摘　　要： 文章以近10年我国图书馆知识产权案件的已决判决书为分析样本,从诉讼主体、诉讼原由、诉讼标的、案件焦点、举证责任、法律依据、判决结果等角度分析图书馆知识产权案件的共性和差异性,探讨案件的特点。结合专家访谈,分析我国图书馆所处的知识产权环境和突出的知识产权问题,提出应对措施和对未来著作权法的期许。 This article takes dozens of intellectual property infringement cases of digital libraries over the past decade as samples,to analyze the similarities and differences among these cases,from the perspectives of reason of litigation, subject of litigation, focus of cases, burden of proof, legal basis etc. Combined with interviews results,the authors strive to conclude the intellectual property environment of libraries in China,the prominent problems of intellectual property in the libraries. Finally, this article proposes some recommendations and expectations for the future of copyright law based on the requirements of digital libraries, and discusses its implications for public digital culture construction.
