摘 要: 作为“未成年人”和“残疾儿童”双重身份的学生,其受教育权的保障在很大程度上取决于家长教育权利的行使。美国(《残疾人教育法》及其相关法律对残疾儿童家长的教育权利做出了明确、具体、详细的规定。美国残疾儿童家长的教育权利主要包括程序性保护及其知情权,教育记录获取、保护、销毁权,教育参与权,教育救济权,以及获得指导、咨询、培训、服务的权利。 Because of the dual identity of minor and individual with disabilities, to some extent the realization of individuals with disabilities' rights to education depends on the exercises of the educational rights of their parents. American act and its relative statues on the education of individuals with disabilities have made specific and definite education rights entitled by the parents of the individuals with disabilities. These rights include the right of the procedural safeguards and its information, the rights of accessing, protecting ant/destroying the educational records, the rights of education participation, the rights of education relief and the rights of getting the guide, consultation, training and services.
