摘 要: 在实际运作中,人民政协组织具有"机关性"的特征。在应然理念层面上,人民政协制度则具有"场域性"的特征,是政治协商、民主监督、参政议政等政治活动的运行平台,是社会主义协商民主的发生场域。基于结构主义的观点忽视了人民政协独特的政治定位。从功能主义的视角来看,政协职能活动具有极强的政治性与表意性,人民政协应定位在政治公共领域,而与国家权力体系平行。应采纳功能主义的视角,实现人民政协法制化切实可行的途径是完善政治协商程序的法律规定。 In actual operations, the CPPCC organizations share the characteristics of "government authorities". How- ever, on the level of necessity concept, the CPPCC system should have the characteristics of "field", as an operational platform for political consultation, democratic supervision, participation in politics and other political activities, and as the field of occurrence for socialist deliberative democracy. Theories based on structuralist viewpoint ignore the unique political positioning of CPPCC. From the perspective of functionalism, CPPCC's functional activities have a strong political and ex- pressive nature, so CPPCC should be positioned in the political and public domain, in parallel with the national power sys- tem. It is advisable to take the functionalist perspective, and the feasible path for realizing legal reform of CPPCC is to im- prove the legal provisions for political consultation procedures.
