摘　　要： 行政公务回避制度是行政法领域一种重要的程序控权机制,它在控制行政权力的滥用、保障行政公正方面有重要的意义。二十世纪以来,随着对行政行为的控制从实体控制转向实体与程序并重,回避制度为许多国家行政程序法所采用。但在我国这一制度还不太成熟。在理论研究领域,一些行政法论著虽然对公务回避问题有所提及,但也仅限于对国外相关制度的简单介绍,虽然我国现行的诸多法律、法规都不同程度地规定了行政公务回避制度,但过于概括、简约。但这项制度的构造性缺陷依然比较明显,不论是该制度的实体规定,还是程序设计,多原则性而少操作性和针对性,难以在实践中运用。目前,在世界大部分国家或地区的行政公务回避制度比较完善的情形下,我国的行政公务回避制度却存在着诸多问题,因此,对行政公务回避制度这一相对比较薄弱的环节进行系统深入的研究具有重大的理论和实践意义。 本文首先探讨了行政公务回避的基本理论,其次比较分析了国外及我国台澳地区的制度实践以及对我国的启示,接着深入分析了我国现行行政公务回避制度的现状、弊端及其成因,最后对我国行政公务回避制度的完善提出了相应的措施。论文共分四部分： 第一部分,行政公务回避的一般理论。本章首先阐明了行政公务回避的涵义,其次阐述了行政公务回避的理论基础,其法理基础为自然正义原则与正当法律程序原则,其社会学基础是人性论,论述了它们对行政公务回避的建立和实施所具有的意义。再次指出了行政公务回避的价值。 第二部分,国外及我国澳台地区制度实践与启示。本章以德国、葡萄牙、美国、英国、台湾、澳门等国家和地区为例,从行政公务回避的理由、行政公务回避的程序、行政公务回避的法律后果这三个方面深入研究了� The administrative official evasion system in the administrative law domain is one kind of important procedure controls of the power mechanism, it has vital significance towards the safeguard on fair control in administration authority. Since the 20th century, developing with the whole system on procedure of the administrative action, the government pay great attention to this aspect. The evasion system was taken by many national administration procedural laws. But in our country the concerning system is not a mature one. In the fundamental research domain, although some administrative laws are discussing evasion topics, the essays is only restricted in introduction of the overseas correlation system. Although our country presented many laws during the past years, the laws and regulations were all varying among the degree of stipulating the administrative official evasion system, summarizes brief only. But it is obviously that this system is due to be constructed. Even stipulated in the programming, the entity system, the multi-senses of principle had not been operational and pointed our till now. With difficulty in reality utilizes, the further consummates of this system from the law is already imperative. At present, the majority of countries in the world, the system is perfect situation, our administrative official evasion system has many problems actually. To conduct the concerning research thorough system of administrative official evasion system has great significance both on theory and practice as far as this relative weak link is concerned. This article firstly discussed the administrative official evasion elementary theory, and then introduce the comparative analysis overseas and the relative ideas in Taiwan island and Macao area, together with the practice system, as well as the enlightenment to our system. The second step is thoroughly analyze the present administration official evasion system base on the searched situation presently, including the malpractice and the origin, and finally propose
