摘　　要： 本文首先从中英商业秘密法律保护的界定及其法律体系分析。其次是从中英商业秘密的界定及其法律保护概述出发,通过比较中英两国商业秘密的立法定义、范围和构成要件的异同,明析了中英商业秘密保护法律体系特征。再者,文章介绍中国及英国两国对侵犯商业秘密行为的认定,并透过比较两者异同,反思本国法律制度存在的问题,并进行分析研究。此外,文章通过中英两国对侵犯商业秘密的法律救济制度比较,思考中英对侵犯商业秘密行为认定及法律救济制度,并提出若干思考借鉴。最后,文章探讨完善我国商业秘密保护法律制度应遵循原则,并提出完善我国商业秘密保护法律制度的若干建议。 In this article, it firstly analyzes the definitions and legal systems aboutChina and England trade secrets protection legal systems. Then, starting fromthe overview of the definitions and legal systems, through comparing thelegislative definitions about China and England trade secrets, scopes and thedifferences and similarities of major factors, clarified the characteristics ofChina and England trade secrets protection legal systems. Furthermore, thisarticle describes the identifications of the infringements of trade secretsprotection in China and England separately. By comparing the two countries inthese matters, identifies the problems existing in the legal system in China andanalyzes the problems accordingly. Apart from these, in this article alsocompares the remedy systems of infringements of trade secrets protection inChina and England, analyzes the identification and the remedies ofinfringements of trade secrets protection of the two countries, then providingcertain recommendations. Finally, this article states the principles to befollowed for improvement of trade secrets protection legal system in China, andgiving certain recommendations for trade secrets protection legal system inChina.
