摘　　要： 这次由宏观经济周期的变化和微观上的金融创新浪潮交叠在一起所产生的美国次贷危机,对全球经济造成很大破坏。我国宏观经济在国内结构性失衡和国际金融危机的双重压力下,出现了前所为未有的复杂局面,给我国金融调控政策的选择带来了巨大挑战。 面对全球性的金融风暴,本次金融危机涉及的法律问题很多,本文主要关注的角度是法律对经济既要起到最基本的保障与支撑作用,又要加强自己的超前预测,直接或间接地引领经济。那么,在此次危机中,思考如何从法律层面在金融调控角度去创造促进金融创新的反危机的保障机制。 故此本文,探讨我国金融调控法律制度研究:第一,从金融海啸下对我国的经济冲击说开起,提出金融海啸引发的我国金融调控的法律思考,提出了金融调控的创制性与合法性的矛盾、金融调控扩张冲动与法律约束的制衡以及金融调控协调机制等方面的现实诉求。第二,探究金融海啸下凸显我国金融调控的法律制度缺陷,反思其原因,从而明晰了上述现实挑战的深层次原因以及对电子自助进行法律规制的基本思路。第三,对国外金融调控主体、金融调控的创制和金融协调机制的法律制度等方面的立法规定进行了分析和评述,以期获得完善我国金融调控的给予借鉴。第四,首先从宏观层面勾勒出重构我国金融调控法律制度的总体设想,然后在微观层面围绕立法框架而规定我国金融调控法律制度的具体内容,并对前文所论及金融海啸所引发的现实挑战作出法律规制回应。 As financial crisis will eventually hurt real economy when it develops into certain stage,and with the development and the open of the economy in China and the trend of financial 'all-in-one',in the world economy,the sudden break- out of international financial crisis becomes possible,and the result becomes more and more serious.They can place a premium on the crisis.So we have to adopt the precautionary measures to prevent the international financial in good season.Then our economy can develop healthily and rapidly. The major cause triggering the Sub-prime Mortgage Crisis is that the financial regulation system couldn't follow the step of fmancial innovation so as to lead to lack of supervision,we shall analyze the feasibility and major effects of the supervision regulation system in practice as well as offer the lessons and experiences for China. To safeguard financial security,we have to explores r deeply probes into the root of the outbreak and exacerbation of this financial crisis and create a more integrated and systematic regulatory system to match the requirement of financial development.
