摘 要: 在大学这样一个松散的社会组织中,教师的学术研究领域大相径庭,追求的人生理想和价值观也各异其趣,教师的活动以及教师与各方的关系,在很大程度上是靠教师管理制度来规范和维系的。而制度的合理性是教师是否愿意遵从制度的一个很重要的条件。合理的大学教师管理制度是由一定的伦理精神和价值理念来支持的。本论文的研究旨趣就是研究这种伦理精神和价值理念的实体化,即研究大学教师管理制度伦理问题。 大学教师管理的制度伦理研究应回答四个不可或缺的问题:一是大学教师管理制度设计、安排、创新的伦理底蕴是什么?二是中华人民共和国成立以来,我国已经使用或者正在使用的教师管理制度有没有蕴含这种伦理底蕴?现实中缺乏这种伦理底蕴的教师管理出现了什么问题和后果?三是用什么样的原则建构一种我们所期望的、蕴含有我们所要求的伦理精神和道德要求的教师管理制度?四是教师管理制度所依据的伦理精神和道德要求如何实体化、或者制度化?本研究运用义务论伦理思想方法、功利论伦理思想方法、契约论伦理思想方法和理性主义伦理思想方法,以及制度分析法、田野研究法、文献法和访谈法对上述四个问题进行了分析和研究。 论文由反映大学教师管理制度的合理性的两个层面:政府—教师和大学—教师的二则案例提出问题,阐述了研究的背景、现状,界定了有关概念;阐明了研究的意义、价值、所要解决的问题和研究的思路。论文借用逻辑学的概念界定理论,在对已有的制度定义进行归类、分析和评价的基础上,从制度概念内涵定义的属、种差,以及制度的外延和制度的产生四个层面对制度概念进行了分析和界定。并由此指出:大学教师管理制度是规定教师责任,赋予教师权利和利益的规则体系;其功用是规范教师� University is a kind of loose social organization, in which teachers’research domains are far different from each other as well as their ideals and values. To some extent, teachers’activities and the relationships among teachers and others are standardized and sustained by the teacher management institutions. Whether teachers are willing to abide by the institutions or not lies on the rationality of institutions. A rational university teacher management institution is supported by certain ethical spirits and value ideas. The dissertation aims at studying the substantiation of ethical spirits and value ideas--- institutional ethic of university teacher management. Studying institutional ethic of university teacher management, we should answer the four indispensable questions:ⅰWhat are the ethical details or ethical basis of designing, arranging and renovating university teacher management institutions?ⅱWhether the been or being adopted institutions of teacher management contained such an ethical details since the foundation of PRC? If not, what are the problems and consequences appeared in the reality of teacher management?ⅲWhat are the principles needed to construct such a kind of teacher management institution containing the required ethical spirits and moral requests as we are expecting?ⅳHow to substantiate or institutionalize the ethical spirits and moral requests? The dissertation has analyzed and studied the above four issues with ethical thinking methods of deontology, utility theory, contract theory and rationalism as well as institution analytic method, emic field study, documentation method and interview method. The dissertation brought forward issues from two cases, which reflect the two aspects of rationality of university teacher management institution: government—teacher and university—teacher. It elaborated the background and actuality of the study and defines some related conceptions; whereafter, the significance and value of the study as well as the problems to resolve and
