摘　　要： 2008年6月1日实施的《中华人民共和国禁毒法》（以下称《禁毒法》）将公安强制戒毒和司法劳教戒毒两种模式合二为一，在对我国戒毒体制进行重构的基础上，首次提出了“强制隔离戒毒”，既推动我国戒毒工作向法制化、规范化发展，又彰显了我国在戒毒管理体制上注入人文关怀的决心和精神。 强制隔离戒毒从戒毒人员定位为“违法者、受害者和病人”出发，彰显了以人为本的立法精神，突出了教育戒治效果最大化为立法目的。但是，由于《禁毒法》立法原则过于抽象，特别是对强制隔离戒毒立法规制存在体制等方面的诸多缺陷，同时受我国以往强制戒毒体制机制、观念等根深蒂固的影响，强制隔离戒毒执法过程中摆脱不了以前强制戒毒的路径依赖，导致在运行过程禁毒法的精神和宗旨得不到充分体现。 本文以强制隔离戒毒的构建为视角，阐述了强制隔离戒毒制度的法律性质和特征，辨析这一制度与其他相关戒毒制度的关系，总结出强制隔离戒毒制度的优越性和科学性，通过探究当前我国强制隔离戒毒工作中存在的问题，提出自己对健全和完善我国强制隔离戒毒制度的构想。 The Anti-drug Law of the People’s Republic of China /(hereinafter referred to as theAnti-drug Law/) implemented on June1st,2008combines compulsory detoxification throughthe Public Security with detoxification via Judicial Reeducation-through-Labor. On the basisof Chinese detoxification institution’s reconstruction, this law first proposes the CompulsoryIsolated Detoxification. It not only promotes the legal and normalized development ofChinese detoxification work, but also highlights the determination and spirit of humane carein Chinese detoxification management institution. From the perspective of positing the compulsory isolation detoxification persons foroffenders, victims and patients, Compulsory Isolated Detoxification not only shows thelegislation of people-oriented spirit, but also highlights the legislative purpose of maximizingeducation rehabilitation effect. However, due to the fact that the legislative principle ofAnti-drug Law is too abstract, especially at the aspect of Compulsory Isolated Detoxificationlegislation, and limits to the impact of previous compulsory system and deep-rooted conceptin our country, Compulsory Isolated Detoxification enforcement process couldn’t get rid ofprevious path dependence of Compulsory Isolated Detoxification. As a result, the Anti-drugLaw spirit and philosophy couldn’t be reflected in its running process. From the perspective of Chinese detoxification institution’s construction, this paperillustrates compulsory detoxification’s law nature and legal characteristics, analyses therelationship between this institution and other related detoxification institutions andsummarizes the superiority and scientificity of Compulsory Isolated Detoxification institution.Through exploring the current problems of Chinese Compulsory Isolated Detoxification work,this paper proposes the construction idea of well-establishing and perfecting ChineseCompulsory Isolated Detoxification institution.
