摘　　要： 我国自改革开放以来，大力进行国家经济建设，取得了丰硕的成果，国民经济整体水平极大提高，人民生活安定，正向着富裕和谐的小康社会迈进。然而，在这种经济快速发展的和谐社会建设进程中，也出现了一些不和谐的因素，尽管党和国家对于反腐倡廉工作高度重视，但是各类贪污腐败现象层出不穷，极大的影响了党和国家在人民群众心目中的形象，损害了人民群众和国家的利益，非常不利于国家的社会主义建设事业。造成贪污贿赂犯罪案频发的一个重要原因就是我国有关惩治贪污贿赂犯罪的法律法规还不够健全，其在量刑标准方面还存在着一些不完善的地方。这种情况极大的降低了我国法律的公信力，非常不利于我国建设法制社会的目标的实现。任何法律的量刑都须遵循明确的原则。纵观我国建国以来的量刑原则，不难发现我国的量刑原则越来越合理。通过学习国际上先进的经验，我国的量刑制度也得到了极大的改善，为我国科学的量刑制度的建立进行了充分的准备。 Since China the reform and opening up, and vigorously carry out national economicconstruction, and achieved fruitful results, greatly improving the overall level of the nationaleconomy, the people live in peace and harmony,the whole country is toward affluent well-offsociety forward. However, in the rapid economic development process of building aharmonious society, there have been some discordant elements, although the party and thecountry attached great importance to anti-corruption work, but all kinds of corruption afteranother, a great impact on the party and the country's image in the eyes of the people, harmthe interests of the people and the country, is not conducive to the country's socialistconstruction. an important reason on the frequent cases of corruption and bribery is thatChina's relevant punishing corruption and bribery laws and regulations are still inadequate inthe sentencing standards, there are still some imperfections. This greatly reduces thecredibility of our laws, the legal system is not conducive to building our community goals.Any law principles are to be followed explicitly. Throughout founding principles ofsentencing, it is difficult to find more reasonable. Through the study of international advancedexperience, our sentencing regime has also been greatly improved, as our scientific sentencingregime established were fully prepared.
