摘　　要： 近年来，我国虐童现象频发，使得禁止虐待儿童再次引起全国上下的强烈关注。但我国现行法律对虐待儿童行为的规制过为原则化，缺乏可操作性。刑法作为保护人民合法权益的底线，对虐待儿童行为没有具体的罪名予以规制，使得国家司法机关对该类虐童行为无法可依，不能及时地保护儿童的合法权益。我国相关学者建议修改现行刑法，使虐待儿童行为可以有效得到刑法规制。 本文第一部分从我国现实生活中的典型案例引出了虐待儿童的问题，介绍了虐待儿童行为的概念和特点，具体分析了我法律对虐童行为规制的立法现状和司法现状，找出现行立法存在的缺陷和不足。第二部分考虑到我国现行法律框架下规制虐待儿童行为的困境，通过考察境外对虐待儿童行为的法律规制，结合我国现行法律制度的不足，总结出国外关于虐待儿童的立法特色及对我国的启示。第三部分针对前两部分总结的我国法律对于虐待儿童行为存在的问题以及在分析借鉴国外立法现状的基础上，提出我国虐待儿童行为刑法规制的设想，包括虐待儿童行为刑法规制的立法途径、虐待儿童罪的法条设计以及虐待儿童罪的构成特征,以完善我国刑法对虐待儿童行为的规制。 China has initially established a special protection of children's rights legal system. ButChina's law on the regulation of child abuse is more general and lack of maneuverability.Criminal law as a last line of defense in protecting children's health interests, has nocharges to be regulated on child abuse, which make judicial indulgence of criminals, failedto effectively protect the legitimate rights and interests of children. Our scholars propose toamend the Criminal Code to make child abuse to get criminal regulation. The first part of real life from a typical case raises the issue of child abuse, introduces theconcept and characteristics of child abuse, detailed analysis of the current situation of thelegislative and judicial status of my child abuse laws regulating behavior, and to identifythe presence of existing legislation defects and deficiencies. The second part of theconsideration to the plight of China under the current legal framework regulating childabuse, by examining the outside of child abuse in the legal regulation, combined with lackof our current legal system, summed up the foreign legislation characteristics on childabuse and Implications for China. The third part for the first two parts of the summary ofthe law for child abuse problems and the analysis of learning status of foreign legislationproposed based on the idea of child abuse criminal regulation, including legislativeapproaches child abuse criminal regulation, abuse law of the crime of child design andcharacteristics constitute the crime of child abuse, in order to improve our criminal law onthe regulation of child abuse.
