摘　　要： 随着经济的发展，纠纷方式越来越多样化，我国各地法院不断出现“诉讼爆炸”，用诉前委托调解方式解决纠纷是把案件解决在法院立案之前，其一定程度上减少了进入诉讼程序的案件，因此其纷纷被各地法院以各种形式实践。但我国法律对此没有明确的规定，因此对其研究具有很大的理论意义和现实意义。本文主要分四章，各章的内容分别如下： 第一章主要介绍诉前委托调解的基本理论。对诉前委托调解的概念、性质、功能、特征进行详细的介绍。并将诉前委托调解与几个容易混淆的概念进行了比较，为下文我国诉前委托调解的构建奠定基础。 第二章是介绍国外及台湾地区的在构建我国诉前委托调解时值得借鉴的调解制度。主要介绍了美国、日本及我国台湾地区的调解制度，通过比较分析，总结出值得我国构建诉前委托调解制度的借鉴的做法。 第三章对我国委托调解制度的现状包括立法方面和司法方面及存在的问题，本文重点介绍我国现阶段主要的四种司法实践类型：“人民调解窗口”型、“诉调联合”型、“特邀调解员”型、“基层组织、专业机构”型。并指出诉前委托调解存在主要的问题。 第四章是提出我国诉前委托调解制度的构想，该方案的主要内容包括诉前委托调解的原则、调解范围、调解主体的确认、调解的程序及调解保障等方面。 With the development of our national economy, the court appears “litigationexplosion”succession.The pre-entrusting mediation has function of shunting cases,So it has great theoretical and practical significance to study.This paper is divided intofour chapters, the contents of each part are as follows: The first chapter introduces the basic theory of the pre-entrusting mediation. Itdetails the concept and features of the pre-entrusting mediation and the relevantprovisions in current law relating to the pre-entrusting mediation. Otherwise, itcompares the pre-entrusting mediation with people's mediation and lawsuitmediation.For a better understanding of pre-entrusting mediation. The second chapter gives brief introduction of relative system in abroad and area.It respectively introduces court annexed mediation in USA,mediation system inJapan,and pre-litigation mediation in Taiwan. Get inspiration to Perfecting the oursystem by the comparisons. The third chapter introduces the Current legislation and practice of thepre-litigation mediation,Especially the people's mediation window,litigation mediationcombined, specially invited mediators and grassroots organizations, professionalbodies then analysis those practice.to pointed out the problem. The fourth chapter discusses construction of institution of pre-entrustingmediation. it Introduce the principles of pre-entrusting mediation. Then it discussthe pre-entrusting mediation's range of application, procedure, mediationagreement's legal effect, linking to litigation procedure and other subjects.
