摘　　要： 科学技术的进步丰富了人们的生活，改变了人们的生活方式，与之相对的是人们所拥有的财产形式也在不断变化，网络数字财产的出现给人们的生活增添了色彩，但同时也给其财产身份的认定带来的不小的争论。财产权其实确认的是人与人之间的关系，但是目前的境况则是：一方面是网民们兴致勃勃的对自己所使用或持有的网络数字财产的悉心经营，另一方面则是法律的空缺与网络服务协议的桎楛,这两方面的困境致使网络数字财产的保护处于荒芜状态。目前学术界对网络数字财产的研究已经十年有余，但是关于网络数字财产的法律属性仍然未有定论，其所具有的独特特征，也是众说纷纭，但是学界对此的通识却是不容忽视的，即网络数字遗产的可继承性是无可争辩的，只是具体网络数字遗产范围有待进一步明确，继承的操作程序需要进行详细的设计。我国继承法修律在即，学界也有学者就网络数字遗产继承的范围进行研究，并且提出增加网络数字遗产的建议。 本文，笔者从现实的案例出发，总结出网络数字财产继承所存在的问题，主要涉及网络数字财产法律定性问题、网络数字遗产继承的法律缺失、网络服务协议对网络数字遗产继承的阻碍、网络数字财产价值评估的困境等，并对这些问题进行分析，在此基础上介绍了网络数字遗产的特点，并对其进行了归类，最后，对我国网络数字遗产的继承提出自己的建议，以期对数字遗产的继承制度建设有所裨益。 The progress of science and technology has enriched the life of people, changed people'sway of life, as opposed to a people have the property of the form is also changing, theemergence of network digital property add colour to people's life, but also bring thecognizance of the property of a big argument. Property rights actually confirmed is therelationship of the people, but the current situation is: on the one hand, netizens enthusiasticabout their use or held by the network digital property of meticulous management, on theother hand, the service agreement is the legal vacancy and the network consumes Hu.Presently the research of network digital property had been more than ten years, but whatabout the legal attribute of network digital property is still inconclusive, it has uniquecharacteristics, is also debated, but the academic circles of the general is not allow to ignore,the network of digital heritage inheritance is indisputable, but the specific operationalprocedures need to be designed in detail. XiuLv inheritance law in China, also some scholarson the network digital inheritance the scope of the study, and put forward Suggestions ofincreasing network digital heritage. This article, the author embarks from the real case, summed up the network digital inheritedproblems, mainly the network digital property law qualitative problems, loss of networkdigital inheritance law, the network service agreement of network digital inheritance block,the plight of network digital property value evaluation, etc., and the analysis of theseproblems, on the basis of this, the author introduces the characteristics of network digitalheritage, and carries on the classification, finally, to our country network digital heritageinheritance of its recommendations, in order to help to inherit the system construction ofdigital heritage.
