摘　　要： 新修订的《中华人民共和国刑事诉讼法》（下文简称<刑事诉讼法>）在特别程序中增加了“犯罪嫌疑人、被告人逃匿、死亡案件违法所得的没收程序”（下文简称刑事特别没收程序）的规定。该规定自出台之日起，便引起刑事诉讼法学界的广泛关注，学者们对此也展开了深入的探讨。虽然学者对此程序的设立褒贬不一，众说纷纭，但毋庸置疑的是，这一程序的设立契合了我国已加入的联合国相关公约与决议，并与世界性的反恐问题的决议之要求相呼应，有利于有效地重点打击贪污腐败犯罪和恐怖活动犯罪。 对于我国司法实践来说，刑事特别没收程序这一程序在《刑事诉讼法》中的确立在一定程度上解决了我国司法实践中长期存在的相关难题，打破了刑事司法过程的困局。然而，此程序仍存在一些不足之处，在实践中未能完全实现设立该程序的原有意图，例如适用范围模糊、主管机关职责不明确等。因此，本文在对刑事特别没收程序的相关内容进行厘清的基础上，对该程序存在的不足进行了概括。笔者对这一现状进行反思的过程中，亦对其他国家的相关规定进行了简要的解析，进而提出完善我国刑事特别没收程序的构想。 The newly revised Criminal Procedure Law increases the " criminal suspects and defendantsinto hiding, the death of the illegal income confiscated Program" in the special programrequirements. The provisions from the date of introduction, it caused widespread concern inthe Criminal Procedure Code academia, scholars have also launched an in-depth discussion.Although scholars have established procedures mixed, different opinions, but no doubt thatthe establishment of this program fit the country has joined the United Nations conventionsand resolutions related, and with the worldwide fight against terrorism demands theresolution of the echoes, conducive to effectively focus on combating corruption corruptioncrime criminal and terrorist activities. For our judicial practice, Special Procedure of criminal forfeiture is establishing a certainextent, solve the long-standing practice of justice related to the problem, breaking thecriminal justice process predicament. However, this process there are still some deficiencies,has not been fully realized in practice, establish procedures to change the original intent,such as fuzzy scope, authority and other responsibilities are not clear. Therefore, on thebasis of the criminal forfeiture proceedings related to special content to clarify on the lack ofexisting procedures are summarized. The author of this process of reflection on the currentsituation, the relevant provisions of other countries also carried out a brief analysis, and thenput forward a sound idea of special criminal forfeiture proceedings.
