摘　　要： 基于位置的服务（Location Based Service）简称LBS，即通过采用定位技术确定用户位置信息，利用移动互联网技术为用户提供与其位置信息相关的增值服务。LBS技术作为实现智能城市、智慧生活的重要技术支撑，为人们生活带来了许多便利。然而，剑有双锋，用户位置隐私的安全问题也日益凸显。由于位置隐私作为法学领域的新生事物，其在民法领域的保护存在诸如法律属性难以界定、侵权责任认定困难及保护模式难以确定等问题。为此，本文将在梳理国内外相关学说的基础上，结合LBS技术在现实应用中的具体情况以及当前我国的立法现状，有针对性地展开论述。全文分为四章，各章主要内容如下： 第一章在分析LBS技术特点的基础上界定位置隐私的概念。主要通过厘清位置隐私与相关概念的关系，全面考察位置隐私的特征，并综述位置隐私的保护困境。 第二章主要探讨位置隐私的法律属性。首先是针对目前学术界对位置隐私法律属性争论不一的现状，对目前两种主流观点进行评析；其次是梳理位置隐私利益与相关权利的关系，综合分析位置隐私利益特点的基础上将其界定为人格权属性。 第三章是关于位置隐私侵权责任的认定，以侵权责任的构成要件为切入点展开论述并解决位置隐私侵权责任的认定难题。最后提出结合LBS技术的特殊性建立具有一定动态性的侵权责任认定系统，针对不同的侵权样态为权利人提供具有一定差异性保护的观点。 第四章是关于我国位置隐私民法保护的思考，本章在第二章将位置隐私界定为人格权属性的基础上展开论述。通过考察域外位置隐私保护模式以及综合考虑我国的立法现状、立法成本、理论体系冲突等影响因素合理选择位置隐私的民法保护模式，并结合LBS技术的具体特点给予相应的完善建议。 Location Based Service means using Mobile Internet to provide users withinformation which relevant to the position value added services. LBS as the support ofour intelligent city and life, brings a lot of convenience for people. However, everycoin has two sides. The safety of the user's location privacy issue is also growing. Dueto the location privacy as a new thing in the field of law, its protection exist somedifficulties. For example, its legal attribute is difficult to define, tort liability andprotected mode are hard to determine. For this reason, this article would be on thebasis of combing the domestic and foreign relevant theory to solve the locationprivacy protection problem. The article is divided into four chapters, and the maincontent of these chapters is as follows: The first chapter mainly talked about the concept of location privacy. Throughclarifying the relationship between the location privacy and related concepts, theauthor summarized the location privacy protection problem. The second chaptermainly discussed the legal attribute of location privacy. First, considering thecontroversies of the legal attribute of location privacy, the article would analyze thesecontroversies. Second, the article would discuss the relationship between the locationprivacy interests and other related rights. At last, through analyzing the characteristicsof location privacy interests, the location privacy would be defined as the right ofpersonality attributes. The third chapter mainly discussed that how to determine thetort liability. The article would use the elements of the liability as the entry point foranalysis and solving the problem. At last, the author made a conclusion that we shouldbuild a dynamic system to provide a certain difference of protection. The fourthchapter was about the civil protection of location privacy. This chapter was based onthe second chapter’s conclusion that the location privacy is of the right of personalityattributes. By researching the foreign location privacy protection mode andconsidering the legislation present situation, legislation cost, the theory system ofconflict, the article would choose an appropriate protection mode for the locationprivacy.
