摘　　要： 作品角色，也称作品中的艺术形象，通常是指在电影、电视、动画等作品中出现的人物、动物或机器人，也包括用语言表现的作品中的虚构人物。不经过作品角色权利人的许可而利用知名作品角色促进商品和服务的销售、或者将具有知名度和影响力的作品角色用于作品的创作，会侵害作品角色权利人的权利，从而招来侵权之诉。因此如何保护作品角色权利人的权益、合理使用作品角色成为一个理论和现实的问题。在中外理论界和司法实践中，有商品化权保护和形象权保护之分。在中国，不论采用哪种保护模式都存在保护范围的有限性和进行新的立法的问题。本文从现有法律出发，主张利用著作权法保护作品角色，以其他法律补充保护作品角色，从而形成作品角色保护的综合模式。 全文共分五部分。第一部分提出问题，并对中外研究现状进行述评，进而提出本文主旨。第二部分对作品角色进行概述，说明作品角色的构成要素、分类、利用类型和权利人。第三部分论述作品角色著作权法保护的必要性和可行性进行分析。第四部分论述作品角色直接和间接获得著作权法保护的条件。第五部分论述著作权法对作品角色的不同类型和构成要素的保护。 总之，由于作品角色源自作品，具有创造性，可以利用著作权法保护作品角色。同时，在不能利用著作权法保护作品角色时，可以运用其他法律对作品角色进行补充保护，这样，充分利用现有的法律构建作品角色综合保护网。 The character of works, also named the artistic image of works, usually meanperson, animal or robot of works which appear in movie, television, animation etc.The character of works also includes the purely imaginative person of the worksdescribed in language. It will violate the right and interest of the obligee that makinguse of a well-known character of works to promote the sale of merchandise andservice or taking advantage of the popularity and influence of the character of worksto create works is without the permission from the obligee of the character of works,which will cause the lawsuit of infringement.Consequently it turns into a academicand realistic problem that how people protect the obligee’right of the character ofworks and use the character of works reasonably. In the theory field and juridicalpractice of China and foreign country, there is difference between using themerchandising right and the right of publicity to protect the character of works. Inspite of adopting which kind of protection modes there exist that the protection scopeis limited and new law is needed to be made in China. On the basis of the existing lawwe advocate to protecting the character of works by making use of the copyright andother laws additionally, and form the comprehensive mode of the protection of thecharacter of works.The article consists of five parts. In the first part the problem is putforward, then the present condition of Chinese and foreign research is reviewed andthe research method and subject of the article is put forward. The second partintroduces the character of the works, explains the type of use and obligee, thecomposing factor and the classification of the character of works. The third partdiscusses the justifiability of using copyright to protect the the character of works.The fourth part discusses the condition of using copyright to protect the the characterof works.The fifth part discusses using copyright to protect the different type andcomposing factor of the character of works. In a word, because the character of worksderives from works, it has creativity and can be protected by copyright. While wecan’t make use of the copyright III to shield the character of works, we may use otherlaws to protect the character of works additionally. Then we can fully make use ofexisting law to set up a synthesized net of protecting the character of works.
