摘　　要： 《香港基本法》自1997年7月1日香港回归之后，实践至今已有十多年的时间。其中，《香港基本法》第158条对《基本法》的解释权作了相关规定，但对于这一条的争议至今仍未解决。2011年6月8日，香港终审法院就刚果民主共和国和中国中铁（香港）有限公司等上诉人诉美国FG Hemisphere AccociatesLLC公司一案，其中就该案所涉及到的基本法第13条、第19条等有关款项向全国人大常委会提出了解释请求。这是香港终审法院首次就有关问题提请全国人大常委会解释《香港基本法》，这也标志着香港终审法院与全国人大常委会良性互动的开启。借着这次契机，本文将通过结合案例分析《香港基本法》第158条在实践中出现的问题，并且就《香港基本法》的性质和第158条内容的解析，提出完善《香港基本法》第158条在法律适用方面的建议。 The Basic Law of Hong Kong special administrate region have implementedmore than ten years since July1st,1997, when Hong Kong was reunified. Meanwhile,Article158of the Basic Law of Hong Kong set the rules of the interpretation systemof the Basic Law of Hong Kong. However, the controversy of the interpretationsystem has not been resolved yet. On June8th,2011, because of the case of theDemocratic Republic of Congo and China Railway /(Hong Kong/) Group Limitedappealing FG Hemisphere Accociates LLC in the United States, it is the first time thatthe court of final appeal of Hong Kong requested NPC Standing Committee tointerpret not only Article13and Article19of the Basic Law of Hong Kong, but alsothe content of the Basic Law of Hong Kong. This motion was also the beginning ofthe positive interaction between the court of final appeal of Hong Kong and NPCStanding Committee. Based on this opportunity, my thesis will point out the problemsof Article158of Basic Law of Hong Kong by studying the cases of interpretation ofthe Basic Law of NPC in the reality. At the same time, my thesis will research thesubstance and content of Basic Law of Hong Kong, and thenput forward somesuggestions tomake the use of interpretation of Basic Law of Hong Kong perfectly.
