摘　　要： 随着数字技术和互联网科技的迅速发展，云计算正逐渐成为IT信息产业的发展趋势，其影响也正在渐渐地渗透到人们的日常生活和工作的各个方面，将引领社会信息化发展的第三次IT技术变革。云存储是云计算当前主要应用之一，在日常生活中，无论我们是否知悉，都在不知不觉中利用到了云存储，例如通过Drop-box、苹果公司i-cloud、谷歌Google Drive上传下载或分享文件，或进入百度网盘、华为网盘或者115网盘里浏览、分享转存、下载转载电子资料等。云存储技术的出现，给人们的工作生活带来便捷、给版权产业带来机遇的同时，也给版权侵权认定和版权保护带来了法律挑战。 在此背景下，本文拟从以下四部分逐步展开研究： 第一部分：云存储与版权概论。本部分在对云存储的基本概念和特点给予界定分析的基础上，介绍了云存储环境下云存储和版权的关系，介绍云存储环境下版权的历史演变和发展趋势，并从版权内容的基本构成要素为切入点，深入分析了云存储环境下版权面临的法律挑战； 第二部分：云存储环境下的版权法律关系研究。本部分从法律关系的基本概念出发，分别阐述了法律关系、版权法律关系、云存储环境下的版权法律关系以及云存储环境下版权法律关系与一般网络环境下版权法律关系的不同点等，从这四个方面来对云存储环境下的相关版权法律关系问题进行了具体阐述； 第三部分：云存储环境下的版权侵权研究。本部分厘定了云存储环境下的版权理论在侵权构成、规则原则、排除事由等方面与传统的版权制度的不同之处，从而提出了目前云存储环境下版权保护所面临的主要问题，并结合典型案例Cablevision案对云存储环境下的版权制度及相关法律问题进行深入探讨； 第四部分：云存储环境下版权保护的对策研究。本部分在明确云存储环境下版权保护的理论基础和三大基本原则的基础上，宏观层面从版权规则理论和版权保护立法提出完善建议，微观层面从司法规则的适用和授权模式的引入来提出对策；最后是云存储环境下的版权保护策略的现实选择。本节从国家层面、企业层面、个人层面三个角度提出了有针对性立法完善建议和版权保护策略，为国家立法和实务部门，以及相关企业、个人在云存储环境下如何保护版权提供借鉴和法律建议。 With the rapid development of digital technology and the Internet technology, cloudcomputing is becoming the development trend of IT information industry, its impact is alsobeing gradually penetrated into every aspect of people 's daily life and work,which will leadthe development of the information society Third times IT technological change. Cloudstorage is currently one of the main applications of cloud computing, In daily life, whetherwe are aware, we all unconsciously take advantage of cloud storage, for example, Uploaddownload or share files by Drop-box, Apple i-cloud, Google Google Drive, or Browse, sharedump, download reprinted electronic data by Baidu network disk, Huawei network disk or115network disk. The advent of cloud storage technology has brought not only convenienceto people's working life and to opportunities of the copyright industry, but also to the legalchallenge for identify and protection of copyright infringement. In this background, this paper intends to study gradually from the following four parts: The first part is the introduction about cloud storage and copyright. In this part makesthe theoretical definition of the analysis on the basis of the basic concepts and features ofcloud storage and describes the relationship between cloud storage and cloud storageenvironments copyright. Then introduce the historical evolution and trends of the cloudstorage environment copyright, afterwards from the basic elements of copyrighted content asthe starting point, deeply analysis the legal challenges copyright of cloud storageenvironment facing; Part II: Research on copyright legal relationship under the cloud storage environments.This part begins from the basic concepts of legal relations, then elaborates legal relationship,the relationship of copyright law, different points between the copyright law relationshipunder cloud storage environments and the copyright law copyright legal relationship undernormal network environment, which from these four aspects to introduce the relationships onthe relevant copyright laws on cloud storage environments; Part III: Research on the copyright infringement under the the cloud storageenvironments. Compare the copyright infringement under cloud storage environments withthe theoretical subject of the traditional copyright from the copyright infringement determining constitute, the principle of the rule, excluding other aspects system and so on,which presents the main problems of copyright protection under the cloud storageenvironment facing by the combined Cablevision case,in order to study the copyright regimecloud storage environments and related legal issues in depth; Part IV: Countermeasures on the copyright protection under the cloud storageenvironment.Definitude the three basic principles of copyright protection under the cloudstorage environment based on the theoretical basis, then make recommendations to improvecopyright rules and copyright protection legislation from the macro-level theory, and toimprove judicial rules and licensing models apply to proposed measures from the introductionof micro-level;The last chapter is realistic choices on the copyright protection strategy forcloud storage environments. The section is legislation proposed targeted proposals andcopyright protection policies from the national level, the corporate level, the individual levelthree angles in order to provide references and legal advice for national legislation andpractices departments and related businesses and individuals on how to protect copyrightunder the cloud storage environment.
