摘　　要： 刑事和解作为新型的犯罪处置机制，寻求的是一种相对平和而非激烈对抗的方式解决刑事纠纷。其在政治上有利于和谐社会的构建，在法律上符合宽严相济的刑事政策，而在理论研究中又顺应了“恢复性司法”的理念。在司法实践中，检察机关作为领头军对刑事和解的工作机制进行积极探索。2012年《刑事诉讼法》、《最高人民法院关于适用<中华人民共和国刑事诉讼法>的解释》、《人民检察院刑事诉讼规则（试行）》和公安部发布《公安机关办理刑事案件程序规定》的相继出台，对检察机关参与刑事和解进行了规范。自检察机关进行刑事和解试点以来，一直广受理论界与实务界的关注，一方面是因为检察机关作为刑事和解探索的先行者和主力军，在开展刑事和解试行过程中探索出了一系列满足现实需要的工作机制和基本和解模式，另一方面基于检察机关职能的特殊性，在开展刑事和解过程中面临着不可避免的争议，加之刑事和解尚处于发展初期，制度的不完善和配套机制的缺漏也阻碍了检察机关顺利开展刑事和解工作机制的步伐，导致检察职能不能有效发挥，刑事和解制度潜在价值未能有效实现。 全文内容共分为四部分：第一部分，基于检察机关率先探索推动刑事和解制度化的原因，探索了检察机关参与刑事和解的理论依据，并分析检察机关对刑事和解制度不可替代的作用。第二部分，从立法现状的角度梳理了现行法律对检察机关参与刑事和解的规定，并对刑事和解参与主体进行分类。在此基础上探讨检察机关在参与刑事和解过程中面临的困境，即作为刑事和解基本主体的检察机关在参与刑事和解过程中基于身份的特殊性引发了争议，并对检察机关开展工作造成阻碍。第三部分，分析实践中公众对检察机关主持刑事和解的质疑，并论证检察机关担任刑事和解主持者的合理性，分析检察机关在刑事和解中的角色定位以化解检察机关尴尬境地。第四部分，完善检察机关具体参与刑事和解的工作机制，以期刑事和解在检察环节能充分发挥其合法、合理地解决刑事犯罪、构建和谐社会的功能。 Criminal reconciliation as a new type of crime disposal mechanism, looking for arelatively calm rather than a fierce fight against the criminal dispute settlement.It is helpful tothe construction of a harmonious society in politics, comply with the criminal policy oftempering justice with mercy,and complied with the concept of 'restorative justice'.In thejudicial practice, procuratorial organs as the leading to actively explore the workingmechanism of criminal reconciliation.In2012, the criminal procedure law,Judicialinterpretation,a trial basis rules issued by the procuratorate and procedure rules of the publicsecurity organ have issued,participate in the conduct of the criminal reconciliation ofprocuratorial organ the specification.Since the pilot of procuratorial organs for criminalreconciliation,it has been widely attention of theoretical and practical circles.On the one hand,because of the procuratorial organ as the pioneer of the criminal reconciliation in exploringand main force, it explored in the process of criminal reconciliation on a trial basis in a seriesof meet the needs of the reality of working mechanism and basic settlement patterns.On theother hand, based on the particularity of procuratorial organ function,the implementation ofthe criminal reconciliation generated controversy.In addition, the criminal reconciliationsystem development is imperfect,mechanisms are also flawed.These reasons hindered thepace of the procuratorial organs to carry out the criminal reconciliation work smoothly andthe role of the procuratorial functions. Full text is divided into four parts: The first part, based on the institutional reasons ofprocuratorial organs take the lead in exploring to promote criminal reconciliation, explore theprocuratorial organs to participate in the theoretical basis of criminal reconciliation, andanalyze the procuratorial organs on the criminal reconciliation system is an irreplaceable role.The second part, combing the current law of procuratorial organ participating in theprovisions of the criminal reconciliation, and analyze the main body of the criminalreconciliation. Explore the procuratorial organs in the plight of the criminal reconciliationprocess.For example, the procuratorial organs in criminal reconciliation as a question-mastergenerated controversy. The third part, analyse the question of the public prosecutors, anddemonstrate the rationality of the procuratorial organs as a question-master. Moreover,analyse the role of procuratorial organs in criminal reconciliation, in order to eliminate theprocuratorial organs of the dilemma.The fourth part, complete the work mechanism ofprocuratorial organ specific involved in the criminal reconciliation, in order to make theprocuratorial organs to give full play to the function.For example, solve the criminal and the function of building a harmonious society.
