摘　　要： 随着我国经济的不断深化发展，城乡交流频繁，大量的农村剩余劳动力流入城市，导致城市人口激增，住房压力越来越大。与此同时，农村却闲置了许多的住房，特别是城乡结合部的农村地区宅基地使用权私下交易问题比较严重。然而，目前我国法律严格限制宅基地使用权流转，流转范围仅限于集体经济组织内部，以致造成宅基地隐形市场和投机活动大量存在，最后影响到集体土地流转市场的发育和完善，也影响到了土地资源的优化配置，还违背了党的十八大三次会议关于完善现代市场体系，建立城乡统一的建设用地市场的决定。因此研究农村宅基地使用权流转具有十分重要的理论意义和现实意义 本文分析了农村宅基地使用权流转的概念、特征及法律属性等基本理论；研究了开放农村宅基地使用权流转的可行性、必要性及开放流转可能引发的问题；然后在对农村宅基地使用权流转的实践和法律现状，及相关法律制度利与弊进行分析的基础上，得出了自己的观点：要有条件、有步骤的放开农村宅基地使用权流转的市场，提出了完善宅基地使用权流转制度的一些建议，并尝试构建一种逐步开放流转的程序，进而为全面开放农村宅基地使用权流转提供理论参考。 With the deepening of China's economic development, urban and frequent exchanges, a largenumber of rural surplus labor into the cities, leading to urban population growth, increasingpressure on housing. At the same time, many rural areas but idle housing, especially in ruralareas land use right fringe of a more serious problem in private transactions. However, ourlaws strictly limit the land use right transfer, circulation was limited to internal collectiveeconomic organizations, resulting in homestead invisible market and there are a lot ofspeculation, and finally affect the collective land circulation market development andimprovement, also affected the land optimize the allocation of resources, but also contrary tothe decision of the party's18three meetings on improving the modern market system, theestablishment of a unified urban and rural construction land market. Therefore, the transferof rural land use right is very important theoretical and practical significance. This paper analyzes the basic theoretical concepts, characteristics and attributes, such as thelegal transfer of rural land use right; study the feasibility of opening up rural land use righttransfer, necessity and open circulation problems may arise; then the use of the ruralhomestead transfer of rights and legal status of the practice, and the pros and cons related tothe legal system on the basis of the analysis, draw up their own point of view: to theconditions and procedures liberalization of rural land use right transfer market, made aperfect house base use right transfer some of the proposed system and try to build a gradualopening of the transfer of the program, and then for the full liberalization of rural land useright transfer theoretical reference.
