摘　　要： 随着我国社会经济的快速发展，传统的劳动关系正逐渐由简单趋于复杂，由个体问题演变成为群体性的社会性问题。处理好劳动关系在社会主义现代化建设中显得尤为重要。目前，我国的劳动争议解决机制经历近几年的立法完善之后，已经能初步适应当代中国经济的发展形势，但在对于农民工劳动权益保护方面，仍然存在着诸多问题。农民工作为我国劳动者中的重要一部分，将其劳动权益保护问题妥善解决是目前我国劳动争议仲裁制度改革和完善工作的关键，也是维持我国经济高速高质量发展和维护社会公平正义、建立和谐社会的重要问题。本文在全面分析我国目前的劳动争议仲裁、劳动争议仲裁制度的前提下，将中外劳动争议仲裁制度进行比较，进而引导出本文的核心问题，即如何针对农民工权益保护的现状进行劳动争议仲裁制度的相关改革和完善。通过本文，可以了解到中国目前的劳动争议仲裁制度和劳动争议仲裁制度下农民工权益保护的情况，对我国未来农民工权益保护和劳动争议仲裁制度的改革和完善具有一定的借鉴意义。 With the rapid development of our society and economy, thetraditional labor relationships are more and more complex. A single individualdispute might lead to a mass social problem. China's labor dispute settlementmechanism has experienced more legislation, and can basically meet theneed of social and economical development. But in the protection of migrantworkers'/(the peasant workers/) rights, there still exists many problems. Migrantworkers play an important part in our construction, but it is hard for them toprotect themselves if any dispute arises. So in this paper, the author discussesthe characteristics of the labor arbitration of China, the differences between thelabor arbitration of China and some other western countries. The author alsopoints out the status quo of the labor arbitration of China, and puts forwardsome suggestions on improving the arbitration.
