摘　　要： 政府在行使社会管理和服务的职能时，必须使用大量的信息资源作为政府决策、管理和服务的依据，这些政府信息资源就包含着大量与个人有关的信息，特别是在现代的信息时代，个人信息具有极大的社会价值和商业价值。在政府信息公开的活动中，政务机关难免会因各种原因公开这些个人信息，造成个人信息的泄露。在我国个人信息保护制度并不健全的情况下，随时会给公民造成不必要的损失。在政府信息公开这样的大背景下，如何能够保护公民的个人信息不被非法泄露、修改和利用是一个非常严峻的问题。从立法层面上看，我国没有一部专门针对个人信息保护的法律法规，对个人信息保护的规定只是零散的分布在各个部门法之中，无法为个人信息提供全面的保护；从实施层面上看，政府机关在对个人信息进行采集、保存和公开的环节中，都会出现泄露个人信息，侵犯信息主体利益的情形。因此，我国亟需建立保护个人信息的法律体系以保护个人信息，也有利于对政府信息公开制度的完善。本文在研究政府信息公开与个人信息保护的相关理论的基础上，分析我国个人信息保护在立法层面和实施层面的现状与不足，然后针对存在的问题与不足提出相应的完善建议，同时借鉴国外的成功经验，在总结前人研究成果的基础上探讨适合我国国情的个人信息保护的立法建议。 Government in the exercise of social management and service functions, plentyof information resources must be used as a basis for the government decision-making,management and service, the government information resources contains a largenumber of personal information, especially in the modern era of information, personalinformation has great social value and commercial value. In the governmentinformation disclosure activities, the government will release the personal informationfor various reasons, caused the leakage of personal information. In our personalinformation protection system is not perfect circumstance, will cause unnecessarylosses to the citizens at any time. In the context of the government informationpublicity, how to protect citizens’ personal information from illegal disclosure,modification, and use is a very serious problem. Judging from the legislative level,China does not have a specific personal information protection laws and regulations,the provisions of the personal information protection fragmented distribution amongthe various branches of the law, which can not provide comprehensive protection forpersonal information; Judging from the implementation level, in the aspect ofcollection, preservation, and open personal information, government agencies alwaysturn out some circumstances, such as disclose personal information, infringe on themessage body’s interests. Therefore, China needs to establish the legal system ofprotecting your personal information in order to protect personal information, and alsoconducive to improve the government information publicity system. Based on theresearch of related theories of government information disclosure and protection ofpersonal information, this article analyzes personal information protection conditionand problems at the legislative level and the implementation level, and then putsforward some improvement suggestions to deal with the problems and shortcomings.Meanwhile, based on drawing on foreign successful experience and summing up theresults of previous studies, it investigates personal information protection legislativeproposals, which are suitable for China’s national conditions.
