摘　　要： 近年，随着全球经济的快速增长，环境污染和生态破坏的现象日益严重，由此引起的环境民事侵权案件逐年增多，且侵权行为和方式都突破了现有法律规定范围与模式，出现许多新的类型，使得受害人的各项民事权益受到损害。实践中，由国内外的大型环境污染事故而引发的环境民事侵权问题屡见不鲜，例如美国墨西哥湾原油泄漏事件、我国的紫金矿业发生铜酸水渗漏事故和近期的中海油蓬莱19-3油田溢油事件都引起国际社会的广泛关注。本文从我国2011年6月的蓬莱19-3油田溢油事件入手，提出环境侵权民事赔偿存在的法律问题和完善我国环境民事侵权法律法规和制度的建议，目的是为了探索出一种有利于保护企业和受害者双方共同利益的法律制度，并且这些法律制度与我国倡导的经济与环境可持续发展的理念相契合，救济环境侵权受害人的同时实现经济的良性发展和对生态环境的保护。 本文正文主要由三部分构成，第一部分引述了2011年在我国发生的大型环境民事侵权事件---中海油蓬莱19-3溢油事件，从该事件的产生和发展分析我国环境侵权民事责任认定和受害人救济方面出现的问题，从该事件给我们的启示中概述了完善我国环境民事侵权法律制度的必要性。第二部分阐述了我国环境侵权的概念与特点，以及介绍了实践中环境侵权民事责任认定与赔偿案件中的难点，这些难点可以通过建立完善的环境侵权法律法规和制度来解决，解决方案设置在第三章。第三部分为本文的重点，提出我国环境侵权民事赔偿在法律制度上存在的不足：一是现有法律对受害方财产损害赔偿范围适用补偿性赔偿原则，实践中对受害人的损害救济程度不够，并且无法起到法律的预防作用，二是环境侵权民事赔偿救济途径有待完善和多元化，实践中我� In recent years,with the rapid growth of the global economy, theenvironmental pollution and ecological destruction is increasingly serious, theresulting environment tort cases increased year by year, and the tort and the wayto break through the existing legal provisions and mode, appeared many new type,make the victims of the civil rights and interests are harmed. At home and abroadin recent years, the major environmental pollution accident caused byenvironmental tort problem, such as the us gulf of Mexico oil spill, China's zijinmining copper acid water leakage accident and recently cnooc penglai19-3oilspill events have caused extensive concern of the international community. Thisarticle from our country in June2011the penglai19-3oil spill events, this paperput forward the environment tort civil liability cognizance and compensationlegal problems and improve the system of our country environment tort laws,regulations and recommendations, the purpose is to explore a kind of beneficial toprotect the enterprise and the legal system of the victim to the mutual benefit ofboth sides, and the legal system and advocate the concept of sustainabledevelopment of economy and environment in our country, corresponds to therelief for environmental tort victims at the same time, realize the benigndevelopment of economy and the protection of ecological environment. This text mainly consists of three parts, the first part quoted in2011in ourcountry large-scale environmental tort incidents-cnooc penglai19-3oil spillevents, from the emergence and development of the event analysis our countryenvironment tort civil liability cognizance and the victim relief problems, fromthe event give us enlightenment in our environmental tort in our country presentsituation and the necessity of perfecting legal system of environmental tort.
