摘　　要： 土地是人类珍贵的自然资源，更是农民赖以生存的条件。土地问题关乎着我国经济的发展。历经三十多年的我国家庭联产承包责任制度，大力地解放了生产力，提高了生产效率，促进经济的发展和繁荣。但是随着我国改革的逐步深入化，我国的农业化和产业化的发展，我国农村土地承包经营制度呈现出越来越不适应农村经济的发展，土地承包经营权流转问题成为当今农业发展亟待解决的问题。 本文从我国农村土地承包经营权和我国农村土地承包经营权流转的定义着手，对土地承包经营权和土地承包经营权转流的特征和意义加以论述，并详细的分析了我国农村土地承包经营权流转的方式。通过对我国农村土地承包经营权流转的现状的分析，总结了我国农村土地承包经营权流转存在的问题。通过对域外国家土地流转制度的分析，总结了我国土地承包经营权流转的制度的启示，在此基础上，对我国农村土地承包经营权流转制度进行了深入的思考。 随着市场经济的发展和法律制度的完善，深入探讨我国农村土地承包经营权流转的问题具有重要的现实意义和理论价值。本文的重点在于分析了我国农村土地承包经营权流转的问题，并且对我国农村土地承包经营权流转制度的探讨，其中包括完善我国农村土地承包经营权流转的法律法规，建立健全我国土地承包经营权市场体系，健全登记制度，保障流转过程中农民的权益等。 Land is precious natural resources of human，it is also important to farmers livingconditions. Land issue is related to the development of China economy. In China，thehousehold responsibility system has experienced30years of change. It is greatlyemancipated productivity in rural areas and it improves agricultural productivity. Itpromotes economic development and prosperity. But with the gradual deepening of reformand accelerate the process of industrialization of agriculture, the development ofagriculture and industrialization in China, the land contract management system becomesincreasingly unsuited to the development of rural productivity, land contractualmanagement rights transfer issue has become urgent to resolve the important issue. The paper started from the land contractual management fight and land contractmanagement rights transfer’s basic concept, dissertate the feature and significance of theland contract management rights transfer and analyze detailed the mode of the landcontract management rights transfer. By way of the analysis of the land contractmanagement rights transfer’s present situation, the paper summarizes the problem in theland contract management rights transfer. By way of foreign countries’ land circulationsystem, the paper summarizes the message of the land contract management rights transfer.On this basis, in-depth reflection on how to improve the land contractual managementrights transfer system. As the market economic development and the gradual improvement of the legal system,in-depth study of rural land contracting and management rights transfer issue has importanttheoretical and practical significance. This article focuses on analysis of the land contractmanagement rights transfer of the status question, and to explore to improve the rural landcontracting and operation rights transfer system. It includes improving the laws andregulations of the land contract management rights transfer, regulating of the land contractmanagement rights transfer, sounding registration system, protecting the interests offarmers during the transfer process and so on.
