摘　　要： 本文从广州市公安机关的角度结合“6.11”事件的处置实例，针对群体性事件的概念进行简单论述：目前，理论界和法学界对群体性事件尚没有统一的概念，存在几种不同的观点，虽表述有所差异，但“以共同或相近利益诉求为目的，以群体参与为特征，以极端行为为表现形式"的特点基本一致。进而引出公安机关在群体性事件处置中的功能和作用，以及公安机关群体性事件应急处置机制的原则，如合法性原则、慎用警力强制措施和武器警械等，处置机制的内容，包括应急组织指挥、应急情报信息、应急保障和现场应急处置。通过对广州市2011年的“6.11”事件的深入分析，指出广州市公安机关应急处置的做法和应急机制中存在的问题，如处置理念政治色彩浓厚、现场处置水平不高、公民基本权利限制过度等情况。由此，笔者认为在公安机关应急处置机制中引入比例原则限制行政自由裁量权，充分保护人权，是势在必行的。在充分借鉴英、美、法、德、日等国家先进应急处置机制、经验、法律的基础上，笔者提出了公安机关结合比例原则的应急处置机制的构想，即各级应急组织指挥部门在充分的应急情报信息引导下，判明事件性质、规模，参与人员身份等情况，据此制定完善应急预案，派出适量处置警力，严格把握处置措施，平衡好恢复秩序与公民权利保护的关系，最大限度追求公益与私利的均衡性。在构想的基础上，笔者提出了完善公安机关应急处置机制的对策，比如将比例原则纳入警察执法的行为准则、树立公益与私利均衡的处置理念、提高现场执法水平等。综合以上论述，笔者认为虽然广州市的群体性事件呈逐年上升趋势，但是作为处置主体的公安机关如果能形成一套完善、高效的应急处置机制，势必在处置中事半功倍，为构建和谐广州作出应有贡献。 This article from the Guangzhou city public security organs perspective combined with"6.11" event handling example, on group events unfolding brief analysis: at present,theoretical circles and law circles on group events is still not unified concept, there areseveral different points of view, although the expression differences, but "to the same orsimilar interests for the purpose, to group participation for the feature, in extreme form"features are basically the same.Then draw out the public security organ mass incidentsemergency disposal mechanism concept, as well as the mechanism of disposal principles,such as the principle of purpose, careful police enforcement measures and weapon, disposalmechanism, including the emergency command, emergency information, emergency supportand emergency disposal site.Based on the Guangzhou City2011"6.11" incident of thoroughanalysis, pointed out that the Guangzhou city public emergency disposal practices and theemergency response mechanism in the problem of existence, such as the disposal ofphilosophy political flavor, site management level is not high, restrictions on citizens basicrights over etc..Therefore, the author believes that the public security organs emergencydisposal mechanism the principle of proportion restriction of administrative discretion, thefull protection of human rights, is to be imperative.The full reference in Britain and theUnited States, France, Germany, Japan and other countries advanced emergency handlingmechanism, experience, legal basis, the author puts forward the public security organ with theproportion principle of emergency disposal mechanism concept, namely various emergencyOrganization headquarters in full emergency information guided, ascertain the nature of theevent, dimensions, personnel involved identity, making perfect the emergency plan, sendingappropriate disposal of police, grasp the strict measures to restore order, balance and civilrights protection, maximize the pursuit of public and private interests balance.On the basis ofthe conception, the author put forward to perfect the public security organs emergencydisposal mechanism countermeasures, such as the principle of proportion into the behavior ofthe police law enforcement standards, establish public and private interests balance concept,improve the level of law enforcement disposal site such as.The above discussion, the authorthinks that although Guangzhou city group sex incident is increasing year by year, but as amain body disposed of the public security organs can be formed if a set of perfect, efficientemergency disposal mechanism, which is disposed in effort, make due contribution for theconstruction of a harmonious Guangzhou.
