摘　　要： 随着社会经济的飞速发展，城乡一体化进程的日益加快，企业下岗工人、农村剩余劳动力和其他失业人员向城市的不断涌入，管理城市的责任担子变得越来越沉重，任务越来越艰巨，这个猫和老鼠的游戏也越来越复杂，矛盾越演越烈。 为什么暴力抗法层出不穷，城管执法处处遇阻，这有着深刻的社会根源，改革开放30多年来，先富的先富起来了，但造成的贫富差距越来越大，贫富悬殊带来了种种社会矛盾，城管和小贩的冲突也在这大矛盾下不断扩大、不断升级、不断恶化。城管执法的行政相对人一般是社会的底层人员，由于被管理者的多样性、复杂性，致使了执法难；目前，全国还没有一部独立的、完备的城市管理法律法规，法律法规的不完善，执法手段粗暴单一，致使了执法难；城市管理工作是一项系统化的社会工程，具有政策性、广泛性和实践性的特征，涉及面广，工作量大，矛盾多，情况复杂多变，而且现在还没有建立健全的部门联动机制，致使了执法难；由于城管部门执法只行使执法权和处罚权，与管理权脱节，致使了执法难。市民对城管工作的不理解，上级部门对城管工作的不支持，导致了执法难。在此背景下，对城市管理的执法理念与执法方式进行变革创新，有着极其重大的现实意义。 本文以广州市城市管理执法方式的变革创新为视角，对广州市城市管理执法的现状、特点、不足进行研究，参考国内外先进的管理执法经验，旨在建立一套科学的、行之有效的城市管理执法方式，达到双赢的目的，实现构建法治的和谐社会的宏远目标。 With the rapid development of social economy, urban and rural integration process isaccelerating, laid-off workers, rural surplus labor force and other unemployed personnel to thecontinuous influx of city, management city liability burden becomes heavier, the task is moreand more formidable, the cat and mouse game is becoming more and more complex, thecontradiction is becoming more and more popular. Why violent resistance to law emerge in an endless stream, the law enforcement is difficult,it has the profound social root.30years of reform and opening up, the rich get rich, but the causeof the widening gap between rich and poor, to bring all kinds of social contradiction, urban andhawker conflict in this big contradiction of constantly expanding, continuously upgrade,worsening. The law enforcement of the administrative relative person is generally at the bottom ofsociety, because the managers of the diversity, complexity, resulting in a difficult to enforce thelaw; At present, the country does not have a separate, self-contained city management laws andregulations, laws and regulations are not perfect, law enforcement means rough single, led lawenforcement difficult; city management is a systematic social project, have policy, extensive andpractical characteristics, involve wide, workload big, contradictions, and complex situation, butnow there is no perfect departments linkage mechanism, so the law enforcement difficult; theurban sector only law enforcement right of law enforcement and punishment, and management ofpower disconnection, leading to difficult to enforce the law. Citizens of urban management is notunderstood, superior departments of urban management is not supported, led to difficult toenforce the law. Under this background, the city management concept of law enforcement andlaw enforcement of innovation, has extremely important practical significance. This article in the perspective of urban management enforcement innovation inGuangzhou, on the present situation and characteristics of Guangzhou urban managementenforcement, inadequate research, reference to enforcement of domestic and foreign advancedmanagement experience, to establish a set of scientific, proven ways of urban managementenforcement to achieve win-win purpose, realize the construction of rule of law in theharmonious society a magnificent goal.
