摘　　要： 随着我国经济的发展，现货交易的局限性已不能满足投资者的需求，融资融券交易制度在投资者的呼唤及时代要求下“千呼万呼始出来”。但由于现行制度规定与融资融券交易的不相一致性，引起关于融资融券担保模式的探讨。 本文将结合我国融资融券交易现状及担保模式的相关规定，对适用我国融资融券交易模式进行深入研究，除了引言和结语外，全文共分为五个部分。 第一部分介绍融资融券交易担保的基本理论。主要对融资融券概念及法律关系进行探讨。 第二部分对融资融券交易进行纵向比较研究。独立开融资融券交易及担保关系，回顾各自的历史发展进程，从中探索二者的发展轨迹及契合之处。 第三部分横向对比分析美国、英国、日本、台湾地区及香港地区的融资融券担保模式，考察各个国家和地区融资融券交易的发展史，从中思考不同法律框架下的担保模式。 第四部分根据我国融资融券交易的具体情况，融合担保法等相关规定，分析现行关于融资融券担保机制的各种方案的可行性，包括信托模式、让与担保模式、及传统的质权模式。 第五部分提出“最高额质权”担保模式与我国融资融券担保机制的契合之处，并深入研究突破最高额质权模式中“流质禁止条款”、“公示方式”以及“担保物价值”三大法律障碍的具体解决路径。 As China's economic development, the limitations of spot trading hasbeen unable to meet the needs of investors, margin trading system increated by the investors and the requirements of the times. However, dueto the provisions of the existing system of margin trading is not relativeconsistency, caused by of margin guarantees mode. The first part introduces the basic theory of margin tradingguarantees. Mainly to express the concept of margin trading and legalrelationship. The second part of the Longitudinal Study of margin. Independent ofmargin trading and guarantees relationship, review the historicaldevelopment of the process, from which to explore the development of boththe track and the combination of the system. The third part of the lateral correlation analysis of the UnitedStates, the United Kingdom, Japan, Taiwan and Hong Kong margin securedmode, study the history of the development of the various countries andregions margin trading, from which to think about the guarantee mode indifferent legal systems. The four part, based on the specific circumstances of the margintrading, the integration of the relevant provisions of the Guarantee Lawand margin, analyze the feasibility of the existing margin variousprograms of the guarantee mechanism, including trust mode, alienationguarantee mode and the traditional right quality mode. The five part presents the margin guarantee mechanism selectablesystem through a comparative analysis pointed out that the suitable ofThe maximum amount of the right quality mode, and finally analyse the solution of liquid prohibitions,Public way and the value of thecollateral.
