摘　　要： 2003年以来网络舆论愈来愈显示出其强大的力量，不仅能够设置议题，有时甚至直接推动事件的发展，并对现实生活和当今中国社会和政治产生重大的影响。网络维权活动的实践中，网民通过网络传达民意、集结活动并对政府决策产生影响，体现了其民主潜质和对中国公民社会建构的积极影响。同时，网络维权活动也存在着一些非理性因素，如不加重视和引导容易产生负面的影响。本文在梳理公民社会理论的基础上，明确中国公民社会建设的相关要点。对我国当前的网络维权活动进行案例分析，得出其特点，并从建构中国公民社会的角度审视当前的网络维权活动。通过考察发现，当前中国的网络维权活动蕴含民主潜质，在培育公民文化、发展独立的社会力量及探索公民社会与国家间的良性互动方式有着积极的作用。但同时，当前网络维权活动存在的非理性因素和随机性等特点可能引发公民社会与国家间的关系紧张，不利于中国公民社会的健康发展。 Science2003，public opinion on net shows its powerful force day by day，not only settingagendas，but also directly promoting the development of events. Even more, the public opinionon net begins to have a great impact on the real life and the society and politics of China today.During the process of safeguarding legal rights by net, net citizen express public opinion and gettogether by net, to influence government decisions. This shows democratic potential and greatinfluence for Chinese civil society construction of web activities. However, there are someirrational factors in web activities, overlooking them will lead to negative impaction on theconstruction of Chinese civil society. This paper will firstly introduce the civil society theory,and then point out the main points of Chinese civil society construction. Then analyze andcharacterize the activities of safeguarding legal rights by net from the angle of Chinese civilsociety construction. The conclusion is there exerts demonstration potential in the activities ofsafeguarding legal rights by net. These activities have positive impaction on cultivating civicculture, developing independent social forces, and exploring benign interaction relationshipbetween country and civil society. Nevertheless, the irrational factors may course the relationshipbetween country and civil society going bad, which will do harm to the construction of Chinesecivil society.
