摘　　要： 案例指导制度是我国司法改革的重要内容。我国的案例文化起源于西周时期，发展至今已形成一定的特色。中国的案例指导制度显现出具有指导性、规范性、司法管理性、具体性等特色。通过对案例指导制度的研究发现仍存在指导性案例效力不确定、司法管理行政化、裁判要点抽象、适用方法不熟悉、监督与考核缺少等问题。为了使案例指导制度能更好地发挥功能，应对制度进行完善。制度完善的措施主要包括：明确指导力范围、合理进行司法管理、掌握适用方法、指导性案例信息化建设、加强监督与考核。此外，从制度的外围进行改革：建立背离报告制度和改革案件请示制度。 The case guidance system is an important content of China's judicial reform.Ourcase culture originated in the Western Zhou Dynasty, the development has been theformation of certain features.China's case guidance system showing guidance,regulatory, judicial management, the four specific characteristics. Case guidancesystem found that the effectiveness of the guiding case there are still uncertain, theadministration of justice administration and the referee points abstract, the method ofapplication are not familiar with the lack of supervision and assessment and otherissues. In order to make the case guidance system to function better, should improvethe system. The system measures include: clear guidance on the scope of force, theadministration of justice reasonable grasp of the applicable methods, guiding caseinformation construction, strengthen supervision and assessment. In addition, from theperiphery of the system reform: the establishment of a departure from the reportingsystem and reform system of case referrals.
