摘　　要： 荫庇行为古已有之,它与中国历史紧密相连。它产生的基础是血缘关系,同时也包括其他各种社会关系,在中国两千多年的封建社会,“世袭制”和“门荫制”是当时封建统治的基础,也是荫庇腐败产生的历史渊源。但荫庇腐败却不是生而有之,它是社会发展到一定阶段的产物,是现代化大生产的产物,也就是在当代民主社会下,荫庇行为与权力相结合的结果。时至今日,虽然社会有了很大进步,但荫庇腐败却广泛存在,这和我国的封建历史传统是分不开的。因此,笔者认为,荫庇腐败的本质是中国两千多年的封建传统在现代社会的体现。研究它的目的就在于明了这种腐败行为产生的原因,带来的危害,以及治理的办法,从而最终能够有效地治理这种腐败行为,以推动我国社会的进步。 荫庇腐败产生的根本诱因是利益冲突,文章主要从防治利益冲突的角度出发,运用行政管理学、政治学、社会学等学科的基本原理,同时运用理论研究与案例分析的方法,在介绍了荫庇腐败的概念、研究背景和目的及国内外研究现状的基础上,对荫庇腐败产生的诱因进行了分析,指出利益冲突是根本诱因,利益冲突包括政治利益冲突和经济利益冲突。荫庇腐败产生的主要社会关系包括血缘、地缘和业缘关系三个方面,这三个关系可能分别导致因家族利益、乡情因素、行业利益而与职权代表的公共利益相冲突产生荫庇腐败。文章介绍了荫庇腐败两种突出的表现形式,即就业方面的荫庇腐败和职务晋升方面的荫庇腐败,并列举了相关的案例。荫庇腐败所造成的社会危害是严重的,它对和谐社会的建设、社会的公平公正及社会民主化进程都产生负面影响。防治荫庇腐败就要从防治利益冲突为突破点,完善相关的制度和加强社会监督,既要完善我国公务员回避制度和加强干部交流及深化干部人事制度改革,同时还要加强社会监督,主要是群众监督和新闻媒体监督以从根本上治理荫庇腐败。 Asylum behavior is from ancient, it is closely connected with the Chinese history. Asylum behavior produce based on blood relationship, but also include some other social relations。In China more than two thousand years of the feudal society,'hereditary system' and 'door shadow system' are the foundation of the feudal rule at that time, also the history origin of asylum corruption, But asylum corruption was not exit at all time, it is the product of social development to a certain stage, the production of modern massive product, and it's the combination of asylum behavior and power under the democratic society, Today, although society has made a great progress, but asylum corruption widespread, This is connected with China's feudal traditional. Therefore, the author hold that the essence of asylum corruption is the embodiment of more than two thousand years of Chinese feudal traditional in modern society. The purpose of study is to understand the causes of this corruption, the harm it bring, and the treatment method, thus finally can effectively control the corruption, in order to promote the progress of our society The fundamental cause of asylum corruption is conflict of interest. This article introduces the concept of asylum corruption, the background and purpose of the research and the situation of domestic and foreign at present mainly from the point of preventing conflict of interest, using the basic principle and discipline of administrative management, politics, sociology and using the theory research and case analysis method. Analyze the fundamental cause of asylum corruption that is conflict of interest, points out that the conflict of interest is the basic incentives including political interest conflict and economic interest conflict. The social relations that lead to asylum corruption mainly include three aspects that are consanguineous, geopolitical and industry margin relationships. The three relationships may cause interest conflicts between the family interests, the countryside factors, and industry interest with the authority which represents the public interests, eventually lead to asylum corruption. The article describes two outstanding forms of asylum corruption:employment and promotion as well as lists some related cases. The harm that caused by asylum corruption is serious. It could lead to negative effects in the construction of harmonious society, social fair and justice and social democratization process. Preventing and harnessing asylum corruption must base on preventing interest conflicts that demand we perfect related systems and strengthen the social supervision. We must perfect our civil servants challenge system and strengthen cadre's exchanges and deepen the reform of the cadre personnel system, at the time enhancing the social supervision, mainly including masses supervision, and the news media supervision so as to harness asylum corruption thoroughly
