摘　　要： 目前，我国正积极推进政府信息公开制度建设。保密审查是政府信息公开制度中的核心问题和关键环节，是行政机关在主动或应不同主体要求公开某一信息前，对该信息是否涉及国家秘密、商业秘密、个人隐私或行政机关工作秘密等进行的最后审查。保密审查实际上决定着政府信息公开的范围，关系到政府信息公开与保密利益平衡点的设定，直接影响着我国政府信息公开制度能否有效发挥保障公民权利、树立政府良好形象和消除社会不安定因素等重要作用。 实践表明，传统的保密审查制度由于审查主体宽泛、审查标准不确定、保密审查程序过于简单及审查责任缺失等问题，已成为制约我国政府信息公开制度进一步发展和深化的“瓶颈”。随着电子政务实践的发展，依靠计算机系统化、标准化、技术化的电子监察技术应用，成为在现有制度约束下对政府工作过程实施全面监控、标准管理、自动采集、智能识别和实时公开的新型手段，在实现保密审查的规范性和政府信息公开的完整性、及时性、准确性与互动性等方面取得了重大进步。 本文从考察政府信息公开与保密审查关系出发，通过对现有政府信息保密审查方式特点及利弊的辨析，探究电子监察手段在实现政府信息公开领域的意义与功能。并综合运用典型研究、比较研究以及规范研究等方法，基于对国内外保密审查经验的分析和启示，进一步探讨建立基于电子监察的政府信息公开保密审查组织体系与技术体系，着力解决其中关于保密审查的技术标准设定和保密审查配套条件约束的两个关键问题。 At present, China is actively promoting the government information system construction.Security review is the core issues and key links of Government Information System. Beforeinformation disclosure required by of different subjects or informs Initiative, making the finalreview to make sure that whether the information involving state secrets, commercial secrets,personal privacy or administrative body of work conducted in secret. In fact, the Securityreview determines the scope of disclosure of government information related to theconfidentiality of government information and balances the interests of the setting and directimpact on Whether the Open system of government information can protect the civil rightseffectively, establish a good image of the government and eliminate social unrest and so on. Practice shows that the traditional confidential review system has restricted the furtherdevelopment of government information disclosure system because of its broad subject of thereview, the uncertain review criteria, the simple security review process and the missingresponsibility. With the development of e-government practices, relying on computertechnology, electronic monitoring technology become a new means to comprehensivemonitoring, standard management, automated collection, identification and real-time public ofthe process of government work in the existing system constraints. It has made significantprogress in the realization of the normative and the integrity of government information,timeliness, accuracy and interactivity, etc. Based on the review of the relationship between government information disclosure andgovernment information security review, the article explore the electronic inspecting meansthe public domain in the realization of the significance of government information andfunctions and explore that establish confidential government information systems andtechnology system review organization with electronic monitoring based on the analysis ofdomestic and international security review of experiences and inspiration, with modelresearch, comparative research, case studies and other methods. Efforts to resolve on twofundamental issues: setting technical standards for security review and support services torestrict government information security review.
