摘　　要： 城市房屋拆迁问题是一个重大的民生问题，汇集了国家政策、产权制度、土地制度、房地产市场等问题的焦点，涉及到诸多主体的利益。利益的矛盾冲突不断升级，因拆迁导致的恶性事件在全国各地不断发生，并且自2011年《国有土地上房屋征收与补偿条例》（简称新《条例》）实施以来依然层出不穷，严重影响了社会的和谐稳定。如何衡平利益分配是当前我国城市化、现代化进程中重大的理论和现实问题。通过探寻拆迁改造过程中房地产收益的变化规律以及利益分配政策选择的新路径，为顺利推进城市房屋拆迁工作提供理论支持和政策建议，从理论上为城市拆迁的研究提供了新的思路和方向，丰富和完善了学界对房地产问题的研究，在统筹兼顾各方利益的基础上为推进我国城镇化战略、全面建设社会主义和谐社会服务。 本文基于利益平衡的思想主要采用规范分析与实证分析相结合以及定性分析与定量分析相结合的方法，对城市房屋拆迁利益分配问题进行了较为系统的研究。研究内容主要包括：界定城市房屋拆迁利益，阐述土地增值产生的原因，在此基础上构建了城市房屋拆迁下的土地增值模型；分析了拆迁利益分配格局的现状及其制度成因，并进行实证分析，提出存在的问题；围绕容积率、拆迁补偿模式和土地储备出让等决定利益分配格局的关键要素为调控手段对现有的利益分配格局进行制度调整；最后提出了相应的政策建议。 在有限的时间、经验及知识下，本文可能的创新主要体现在以下三方面： （1）构建了一个城市房屋拆迁利益分配研究的理论框架。本文通过构建“理论研究一实证分析一制度调整”的框架结构，对我国城市房屋拆迁的利益分配进行了较为系统的研究，具有一定的创新。 （2）从土地增值收益的视角研究拆迁利益分配问题，构建了城市房屋拆迁下的土地增值收益模型，以决定利益分配的关键要素为手段进行制度调整，这是一种理论分析上的创新。 （3）用协整分析的方法以广州为例对城市房屋拆迁利益分配格局进行实证分析从而导出有用的结论，这是一种方法论上的创新。 The urban housing demolition is a major livelihood issue, it focus on national policy,property rights system, land system, the real estate market, and is related to many interest ofdifferent subjects. The conflict of the interest is escalating, a result of the demolition leads toserious incidents continue to occur throughout the country, until2011,“the housing levy andcompensation ordinance of the state-owned land “/(referred to as the' Regulations '/)implemented, but serious incidents are still emerging, and they seriously affect the socialharmony and stability. How to distribute the benefits of urbanization equally is a majortheoretical and practical issue during the process of modernization. This research provides atheoretical support and policy recommendations for the smooth progress of the UrbanHousing Demolition work. Based on the idea of balance of interests, we did a systematic study of the distribution ofbenefits on urban housing demolition through the qualitative and quantitative methods.Research include: define urban housing demolition interests, explain the causes of landvalue-added, build land value-added model of urban housing demolition; describe the statusof the demolition of the interests of the distribution pattern, its causes and the problems; usethe floor area ratio, relocation compensation model and land bank means to adjust the existingpattern of distribution of benefits; Finally, we proposed the appropriate policyrecommendations. The innovation of this article is mainly reflected in the following three aspects:/(1/) Builda theoretical framework of an urban housing demolition the distribution of benefits. Byconstructing theoretical research and empirical analysis of a system to adjust the framestructure, this article give a systematic study of the distribution of benefits of China's urbanhousing demolition./(2/) Study the distribution of benefits from the perspective of the landvalue-added benefits, constructed under the land value-added income model in the urbanhousing demolition, adjust policy./(3/) Cointegration analysis of urban housing demolitionpattern of distribution of benefits through empirical analysis of Guangzhou which lead touseful conclusions.
