摘　　要： 随着人类科技的不断创新和发展，知识产权越来越受到人们的关注，而知识也逐渐成为了一种资产，作为知识产权很重要方面的著作权，其资产价值的断定与法律的保护限制也是为人们逐渐必须考虑和研究的。著作权作为一种无形的，特殊的资产，应该怎样定性定量进行保护是论文研究的中心。论文将以法学为主和经济学为辅的角度对著作权进行研究，希望能对后来者研究著作权有一定的参考价值。 为了研究著作权的法经济问题，我们应该从著作权的私权本质进行研究，因为著作权的私权本质注定了它的主要表现形式是财产性的权利。因为只有确定了这一点才可以融入经济分析的范畴，这也证明了法经济分析方法研究著作权的可行性。这也是我们文章研究的前提条件。而法经济分析方法有很多种，但是用哪一种分析方法来研究知识产权领域的著作权更有效，更合理也是我们所应该讨论的，因为并不是每一种方法都适合研究著作权。 通过确定的法经济分析方法研究著作权，结合中国的实际国情，进行一定量的分析，从法益和经济效益间，社会整体利益和个人利益之间找出一个可以接受的平衡点，以这个平衡点为基准来研究著作权法制建设。 文章的最后，结合前人的研究以及上文对著作权的法经济研究，对中国现有的著作权法若干条款，提出自己的设想和改善建议，希望能对著作权法的后续完善有启发作用。 With continuous innovation and development of human technology, intellectual propertyrights more and more attentions. Knowledge has become a kind of asset. As intellectualproperty is very important aspects of copyright, the value of its assets to conclude with theprotection of the law limits the people gradually have to consider and research. Specialinvisible assets, how should qualitative quantitative protection is the center of the thesis. Thepapers will be Law-based economics, supplemented by the perspective of copyright to studyin the hope of latecomers copyright to the reference value. In order to study copyright law economic problems, we should study from the Privatenature of copyright. Doomed because the private right of the copyright nature of the mainmanifestations of the rights of property. Only identified that can be integrated into the scopeof economic analysis. France Economic Analysis There are many ways, not every method aresuitable for the study of copyright. Reasonable we should discuss. Combined with China's actual conditions, it is a certain amount of analysis. Find anacceptable balance point between legal interests and economic benefits, society as whole andindividual interests. The equilibrium as a benchmark to study the construction of copyrightlegal system is need. The end of the article, combined with previous research, and above copyright laweconomic research, to put forward their ideas and suggestions for improvement on theexisting copyright law in China. I hope that the follow-up to the copyright law perfectinspiration.
