摘 要: 本文通过对食品与食品安全概念进行广义理解,阐释我国危害食品安全犯罪的定义与目前的现状。在此基础上,从不同角度对我国食品安全事故高发的原因进行分析。从刑法规制角度来看,立法上存在对食品安全犯罪的规范范围狭窄、刑罚处罚力度太轻等问题;在司法上存在罪名认定模糊,对单位犯罪“罚而不实”、罚金刑适用不足等问题;此外,还存在食品安全检验制度不健全、风险监测与监管机制匮乏、食品召回制度不健全等相关配套机制问题。针对上述我国食品安全犯罪治理方面的不足,提出完善的建议和措施。 This article through to the food and food safety concept of broad sense,In thefood safety hazards interpretation of crime and the current situation in the definition.Based on this,From different Angle to our country the cause of high rates of foodsafety accidents are analyzed. From the view of the regulation of the criminal law,Legislation in the existence of food safety crime standard narrow、The punishment wastoo light punishment;In judicial exist on charges that fuzzy,To the unit crime"penalty and has no reality"、Fine punishment for such problems;In addition,Thereare food safety inspection system is not sound、 Risk monitoring and lack ofsupervision mechanism、Food recall system is not sound in the related mechanism. Inview of the above food safety management in our country the shortcoming of thecrime,Put forward the improvement Suggestions and measures.
