摘　　要： 近来年,随着中国渔政护渔编队在南沙群岛和钓鱼岛海域巡航护渔工作力度的加强,中国渔政船和中国渔政队伍逐渐走进人们的视野,为人们所熟悉。相对于国家层面的渔政执法行动,地方尤其是沿海市、县一级的渔政执法履行的职责更加多,更加细。 渔政执法也叫海洋与渔业行政执法。随着社会和经济的发展,陆地资源越来越紧缺,人们把目光投向海洋和江河,海洋经济发展迅猛,渔业生产不断提高,海岛开发活动、海洋工程建设项目等越来越多,渔业船舶捕捞活动频繁,传统的海水养殖成了战略性新兴产业等。可以说,海洋与渔业的发展是社会进步的标志之一。但在经济利益的驱动下,随之而来的非法捕捞、滥用渔用兽药、非法倾废、非法采砂等情况也越来越严重,直接侵害了国家权益,危害人民群众健康。地方渔政部门既要保护渔业生产和渔业资源,在所管辖区域履行护渔巡查,打击偷捕、滥捕等行为,履行渔港的执法检查、初级水产品质量安全执法、水生野生动植物保护执法等职能。又要规范用海,保护海洋环境,履行海洋监察职能,负责海域使用、海洋工程、海洋倾废等的执法检查。同时还要承担渔船登记、检查,渔业船员培训;渔业船舶及渔业水域内交通事故的调查处理;调节处理因渔业生产、事故引起的纠纷;渔业事故搜救抢险;查缉渔船走私等工作,依法查处违法违规行为。这样要求渔政执法队伍必须积极应对新形势,坚持与时俱进,进一步加强执法职能,着力攻坚破难。 目前,江门市的渔政执法任务主要由江门渔政支队及其下属各大队、中队三级执法队伍依照国家和省的法律、法规的授权承担。在执法过程中存在执法力量薄弱;执法区域边界界定难;执法对象流动性强;证据保存难等问题。本文试图结合江门地理、海洋与渔业资源,执法案例,借鉴国内外经验和周边市渔政执法经验,分析研究江门渔政履行执法职能的现状和存在的问题,探讨当前环境下如何更好的依法行政,履行渔政执法职责,依法治渔,依法兴渔,保护渔民的利益,维护国家海洋与渔业权益,保障国家海洋与渔业法律、法规的实施,维护国家海洋与渔业管理秩序,促进江门地区海洋与渔业事业全面、协调、可持续、健康、有序发展。 In recent years, with the Formation of china fishery law enforcement patrolling the South China Sea, the boat and the team of China fishery law enforcement gradually into the spotlight. With the social and economic development, land resources are increasingly scarce. People looking to oceans and rivers, the rapid development of marine economy, increasing fish production, the island development activities, marine construction projects, more and more frequent fishing vessels fishing activities, aquaculture has become the traditional strategic emerging industries. We can say that the development of marine and fisheries one of the symbols of social progress. However, driven by economic interests, followed by illegal fishing, fishing with veterinary drugs of abuse, illegal dumping of wastes, illegal sand mining, etc. more and more, directly against the national interests and endanger people's health. China fishery law enforcement in locat, necessary to protect the fishery production and fishery resources, fishing protection in the jurisdiction to perform inspections to combat poaching, fishing and other acts, to perform law enforcement checks fishing, primary fish quality and safety of law enforcement, protection of aquatic wildlife law enforcement and other functions. But also to regulate the use of sea, to protect the marine environment, marine performance monitoring role, responsible for the use of sea areas, marine engineering, ocean dumping of wastes and other law enforcement inspection. But also bear the fishing vessel registration, inspection, fisheries crew training; fishing vessels and fishing waters, traffic accident investigation; adjustment process for fishery production, accident disputes; fishing accident rescue and search and rescue; investigation of smuggling boats, etc., punished according to law irregularities. Currently, the China fishery law enforcement in Jiangmen, the main task of law enforcement detachment from Jiangmen fishery and its subordinate unit, squadron three law enforcement personnel in accordance with national and provincial laws and regulations mandated to undertake. Exist in law enforcement law enforcement is weak; difficult to define the boundaries of the law enforcement area; law enforcement object liquidity; difficult issues such as preservation of evidence. This paper attempts to combine Jiangmen geography, marine and fishery resources, law enforcement cases, learn from experience and experience in law enforcement around the city, analysis status and issues, explore how the current environment better administration according to law, law enforcement duties.
