摘　　要： 随着电子商务的高速发展,网络第三方支付在中国呈现出了必然的发展趋势,它对传统的经营模式产生了巨大的冲击,如何针对网络第三方支付的特点进行有效的法律监管也因此变得迫切。我国电子商务起步较晚,在网络第三方支付方面的法律监管一直处于朦胧状态,这使得网络第三方支付的用户和支付机构都处于相当大的风险之中。鉴于此,本文选择从法律监管的角度对网络第三方支付进行探讨。首先,本文从概念界定与模式分析以及主体关系等三个层面对网络第三方支付进行理论概述,明确了研究对象的外延与内涵；其次,本文从实证角度论述了网络第三方支付中存在的法律风险以及阐述了我国目前的监管措施,通过对我国立法现状与立法缺陷的分析,说明了对网络第三方支付进行法律监管的重要性以及迫切性；再次,本文通过着重介绍美国和欧盟的监管现状,意图寻找到适合中国国情的网络第三方支付监管制度；最后,在前文分析论证的基础上,从监管理念、监管主体和监管制度三个层面提出了完善我国网络第三方支付法律监管的建议。 With the high-speed development of e-commerce, the Online Third-party Payment pattern has been at an irresistible trending with a great impact on the traditional business model existed already. It is urgent to supervise the new business model in the light of its characters effectively. Due to the appearing of e-commerce in China is belated, the legal supervision of Online Third-party Payment pattern still maintain inchoate and unformed, this kind of situation makes the users and the payment organization of this payment system are in considerable risk. Given that status-quo, the essay is going to do some researches on Online Third-party Payment from the aspect of legal supervision and to give some proposals of perfecting to this kind of system on the basis of China's actual conditions and studying on the international advanced model. The first section is to give the over view of Online Third-party Payment. It focus on the general concepts, pattern analysis and the relationships among the subjects, setting the range of the objects of study. The second section is to describe the current situation of Online Third-party Payment legal supervision. It demonstrates the legal risks of it and the supervision system of China, the analysis on the legal situation helps to reason the importance and urgency of legal supervision on Online Third-party Payment.The third section intends to find a supervision system that suits to China's national conditions by analysing the supervision system in Amereca and in the US.The last section puts forward tips of suggestions on how to perfect the legal supervision on Online Third-party Payment on the basis of analysis from regulatory concept, regulatory body and supervision system.
