摘　　要： 20世纪80年代后,行政指导作为一种新型的行政手段开始在我国行政实务界出现,并得到广泛运用。行政指导这一柔和行政方式的实施,不仅在一定程度上弥补了法律空白,,而且促进了我国政府职能的转变,改善了传统的“官与民”之间的关系。但是,由于我国行政指导理论研究和立法的滞后,行政指导在我国行政实务中日益显露出其固有缺陷和负面效应。由于缺失必要的法律规制,致使违法或错误的行政行为长期游离于法治的视野之外,指导相对人的合法权益无法保障。因而,本文主要围绕着行政指导的法律规制来展开。 围绕这一主题,本文共分为五章进行阐述： 第一章,行政指导概述。明确了行政指导的概念、法律性质、功能等行政指导基本理论问题。 第二章,对行政指导法律规制的理论基础进行探究。在信赖利益保护、权力不得滥用、依法行政三种理论进行研究的基础上,探寻对行政指导进行法律规制的必要性与现实性。 第三章,分析我国行政指导法律规制的现状。指出我国行政指导立法及实践中存在的问题,并对存在问题的原因进行剖析。 第四章,总结日本、德国、美国对行政指导进行法律规制的基本情况。 第五章,研究我国行政指导法律规制的完善。分别阐述行政指导的实体规制与程序规制,并确立行政指导法律救济体系,以保护相对人的合法权益。 After the 1980s,administrative guidance as a new administrative means began to appear in our administrative practice, and widely used. Around this one theme, this article is divided into five chapters elaborates the: The first chapter, administrative guidance outline.Clear the administrative guidance the concept, the legal nature of the administrative guidance and functions of basic theoretical issues. In the second chapter, administrative guidance laws and regulations on the theoretical basis of inquiry.In the trusty interest protection, power shall not abuse their administrative law, three theory on the basis of research on administrative guidance, and explore the necessity and reality of laws and regulations. The third chapter, analyses the present situation of administrative guidance laws and regulations.Pointed out that our country administrative guidance legislation and the existing problems in practice, and the reasons causing the problems are analyzed. The fourth chapter, summarizes Japan, Korea, Germany, the United States of administrative guidance on the basic situation of legal regulation. Chapter 5, research in our country's administrative guidance laws and regulations consummation.Elaborate separately administrative guidance entity rules and procedures, and the establishment of regulating administrative guidance law relief system, in order to protect people's rights
