摘 要: 盟神审判是中国民间一种处理民间冲突和争议的风俗。随着中国移民移居东南亚,这种风俗也随之传入印尼巴达维亚华人社会,成为18、19世纪当地华人社会处理纠纷的一种法律手段。《吧国公堂(吧城华人公馆)档案丛书》的《公案簿》第一辑,收录了多种有关盟神审判的案例。本文从当时吧城华人的思想信仰、荷兰殖民统治的政策以及中国的影响等方面来探讨其存在的背景,并根据《公案簿》的案例分析吧城盟神审判的特点及其历史作用。 God's Swear and Judge is one kind of trial by the god and is used to settle conflicts and disputes among people. It was introduced to the Chinese community in Batavia with the Chinese immigration to Southeast Asia and adopted as a legal method in Batavia's tribunal in 18 and 19 centuries. Many cases about it are included in the first volume of Legal Cases in Batavia Tribunal File Collection. This article explores the reasons why it existed from the belief of Overseas Chinese in Batavia, the policy of Dutch colonial government and the influence from China and analyzes its characteristic and effects from the cases included in the Legal Cases.
