摘　　要： “由于民办教育是一种公益性事业 ,所以不能营利” ,这种逻辑成立吗 ?本文在具体分析阐述民办教育的公益性、可盈利性和可营利性的基础上 ,认为民办教育的公益性与可营利性并不矛盾 ,允许部分教育机构合法地营利 ,不仅无损其公益性 ,甚至还会促进整个教育事业的发展 ,从而增加社会公益。 Minban education is a kind of public-benefit, so that it shouldn't be for-profit', does this assumption sound reasonable? Based on the analysis of the public-benefits, economic surplus and profitability of Minban education, this paper concludes that public-benefits is not contradictory to profitability in Minban education. If a part of education institutions were permitted to legally seek profit, it would be no harm to public-benefits, but even facilitate education development, thereby enhance public-benefits as a whole.
