摘　　要： 刑事非法证据的取舍问题由于其自身的独特价值一直是我国立法机关、学术界争论的热点。在明确非法证据内涵的基础上借鉴各国相关制度规定,论述在我国建立非法证据排除规则的现实意义并提出初步构想。 The conflict between acceptance and refusal of criminal illegal evidence is always the focus of legislature and procedural academia because of its special value. This article nails down the connotation of illegal evidence and uses the reference of foreign rules. It has realistic significance to form the exclusionary rule in china. Then this article brings forward the formation of how to set up it.
