摘　　要： 本文主要讨论中国古代刑事审判传统的成因与特征。本文认为 ,与“刑起于兵”一样 ,中国古代刑事审判传统也与部落战争有着密切的关联 ,它还与“皇室国家”或者“家国不分”这一独特政治体制有关。中国古代刑事审判的特点主要表现为“集权”与“非专业化”。 This article discusses the roots and characters of the criminal trial tradition in ancient China. The author holds that as “Punishment originates from war”,the tradition of criminal trial in ancient China relates closely to the tribal warfare; besides,it is also relevant to the particular political system of“royaltied-state”or “integration of family and state”. Accordingly,the Chinese ancient criminal trial is characterized by “centralization of power”and “non-professionalization”.
