摘　　要： 民商法和经济法作为规制市场交易和经济运行的的重要法律部门,对二者之间关系的考察存在多个视角,从法律价值角度看,两者在公平与效率方面各有侧重;在确认和保障自由方面,也有积极与消极之分。 As important legal branches stipulating transactions and economic in function, civil and commercial law and economic law play an important role in securing the sound development of the socialist market.There are several angles where the relations between the two legal branches can be analyzed.The principle of giving priority to efficiency and taking account of justice at the same time must be adhered to micro cosmos.Meanwhile, comparing the view of passive liberty of civil and commercial law, economic law reflects the opinion of active liberty which transcends the former in affirming and ensuring the liberty.
