摘　　要： 本文针对我国学界及司法实践中行政合同主体界定存在的分歧,提出行政合同的显著特征不在于其主体的特殊性,而在于行政合同的签订涉及公共利益,具有超越私法以外的合同条款,从而适用行政法规则。 About the definition of the subject of administrative contract there are many different opinions in the academic circle and legal practices. According to this, this article points out that the most remarkable trait of administrative contract lies not in its special subject, but in its involvement of public interest and different clauses beyond the power of private laws, so it is consistent with administrative laws.
