摘　　要： 夫妻双方的地位平等 ,决定了夫妻双方具有平等的权利和义务。夫妻双方应互相尊重 ,互相保证权利的行使、义务的履行。否则 ,必然造成对对方的侵权。基于“人格独立”、“男女平等”的法律思想和观念及婚姻秩序的要求 ,在民法这一私法范畴内 ,夫妻关系存续期间 ,一方由于另一方的侵权而寻求损害赔偿的法律保护已成为可能。因此 ,构建现代婚姻的侵权损害赔偿制度体系 ,确定不同的侵权损害赔偿的救济方式 ,维持婚姻家庭的稳定 。 Equal marital statue for both sides decides legally the equal rights and mutual responsibility between man and wife. They should respect each other and guarantee the effectiveness of equal rights and mutual responsibility. Otherwise, infringing upon the other's lawful rights would occur. Based upon the legal principle of “individual independent”, “equal rights for men and women”, and the basic requirement of marital maintenance, it becomes possible to ask for compensation of infringing cases as a legal means of self protection in civil court during the period of existing marital relationship. Therefore, it is a further requirement in the marital law system to construct the legal system of compensation of infringing cases, to define the legal procedures of such compensation, and to maintain the normal marital relationship.
