摘　　要： 金融服务业的市场准入问题是一个非常敏感且非常重要的问题。GATS、《有效银行监管的核心原则》对金融服务业市场准入的原则、条件等作出了明确的规定。而我国的相关法律、法规与上述规则相比,在监管的原则、对外资金融机构的内部组织结构与控制制度、资本充足率的要求等方面,仍存在相当差距。我国应放弃不符合GATS的一些限制性规定,实行母国监管原则,完善相应的监管制度,建立起稳健的。 The issue about market access of financial services is very important and sensitive. There are definite stipulations such as the principle, condition of the market access of financial services in GATS, the Core Principles for the Effective Supervision and Control of Bank. The considerable differences exist in the aspect such as the principles of supervision and control, the internal organization structure of foreign investment financial institute, capital adequacy ratio in our relating law and regulation. We should give up the restrictive stipulation that does not accord with GATS, implement the principles supervised and controlled under motherland, perfect the corresponding system of supervision and control, and establish our conservative and competitive financial services.
