摘　　要： 教育保护是国家和学校依法实施的 ,对大中小学校在校学生的人身健康给予与其年龄相当的群体性保护。它是国家和学校的法定职责。教育保护具有从属性、合法性、有限性等法律特征。依法构建教育保护规范、依法履行教育保护职责 ,是预防和处理学生伤害事故 ,保护学生和学校合法权益 。 Educational protection is a legitimate obligation for the state and schools to guarantee students' and pupils' personal health by providing the collective protection corresponding to their ages. Educational protection has the subordinate, legitimate and limited legal features. The formulation of the standard for educational protection and the fulfillment of the obligations for educational protection are the important links for preventing and removing harms from students, ensuring students' and schools' legitimate rights and interests and guaranteeing the healthy development of educational cause.
