摘　　要： 该文着眼于作为社会主义法治主体的人与我国的法治现代化之间的共生互动关系,从法治的实质中发现人的现代性要求,并就现代法治社会应该为人的发展所提供的条件以及现代法治社会之中的人所应该具备的素质作出初步的分析。文章认为,如果没有与法治精神要求相一致的法治主体存在,真正的法治社会就不可能实现。 Concentrating on the interactive relationship between the modernization of the rule of law and human beings as the subject of the socialist rule of law, this paper preliminarily analyzes the requirements for human modernization in the essence of rule of law. It discusses the conditions that the modern society, under the rule of law, should offer personal development, and the qualities of which the persons living in this society should possess. Moreover, a real society under rule of law cannot be achieved unless its citizens have the spirit and consciousness of rule of law. Therefore, the realization of a society under the rule of law in China is a process to incessantly reinforce and cultivate the citizen 's consciousness of rights and of democracy, spirit of freedom, and sense of social responsibility. Namely, the key to the modernization of the rule of law is human modernization, since the modernized human is the only fundamental force for the advancement of the modernization of the rule of law in China.
