摘　　要： 分析了辩护律师在侦查阶段、审查起诉阶段和审判阶段履行辩护职能时的种种制度性障碍,为今后完善刑事辩护制度,保障犯罪嫌疑人、被告人的合法权益提供了具体的事实论证。 The paper identifies a number of obstacles to the advocate in the prevailing system of criminal procedure in China. These obstacles exist in different stages of criminal procedure covering investigation, prosecution and court trial. Consequently, the advocate's role and impact is weakened, which is not conductive enough to guarantee of justice for the suspect and the accused. Henceforth, the paper calls for necessary amendments to the available provisions on the advocate's right in the criminal procedure law.
