摘　　要： 由于仲裁完全基于双方当事人的协议 ,仲裁协议是仲栽管辖的前提。然而 ,作为商事仲裁的前提和基础的仲裁管辖权问题 ,在理论和实践上都未能引起足够的重视。文章就仲裁管辖权的意义、抗辩、抗辩的裁决方式、抗辩的确认以及仲裁管辖权与法院管辖权的冲突与协调等问题试作分析探讨。 Although considered as the prerequisite and basis for international commercial arbitration, the problem concerning jurisdiction over arbitration has not been paid enough attention to both in theory and in practice. This paper makes an analysis into the significance of jurisdiction over arbitration, the counterplea and its adjudication, and the conflict between the tribunal and the court and its coordination.
