摘 要: "定制营销"是现代企业在新的竞争条件下,为占领更多的市场份额而普遍采用的一种营销手段。作为一种新的营销模式,定制营销以其独有的优势在实践中显示出了强大的生命力。但是,如果稍有不慎就有可能落入"专利陷阱"之中,构成专利侵权。针对这种情况,我们对定制营销构成专利侵权的行为进行分析,并在此基础上对如何更好地给予企业相应的法律保护展开探讨。 Customization marketing is the generally used marketing method by modern enterprise to get more market share in competition. As one kind of new marketing pattern, customization marketing demonstrates its formidable vitality in practice, thronging the unique superiority. But any slightly carelessness may possibly lead to falling in "the patent trap" and constituting patent infringement. In order to deal with such kind of situation, we must analyze the patent infringement behavior in customization marketing and give enterprise some advice on how to get more legal protection.
