摘　　要： 作为商人习惯法的《跟单信用证统一惯例》不可能对信用证的方方面面都作出规定,涉及信用证欺诈问题时,主要依靠各国的国内法加以解决。多年来,我国有关信用证欺诈法律制度的建设一直处于不断进步中。文章针对我国信用证欺诈例外法律中的若干疑难问题,从程序和实体两个方面进行分析,以助于进一步完善我国处理信用证欺诈的法律制度,充分发挥信用证在国际交易中的支付功能,保障国际经济贸易秩序。 As the merchant common law,Uniform Customs And Practice on Documentary Credit doesn’t stipulate all contents of documentary credit.The documentary credit fraud problem mainly depends on the civil laws of all countries to solve.For a long time past,the legal system construction of documentary credit fraud has been in state of continuous progress.This paper attempts to have a study on some difficult problems of documentary credit fraud exception from both sides of the substantive law and procedure law to help complete the related law system,and to make L/C play a better role in international trade settlement to keep the international economy and trade in good order.
